DVC Point Transfer Question

I have read through the "DVC Rent/Trade Points FAQ" section as well as the other links on this page. I have found several written contracts that are appropriate for point rentals where I am setting up the reservation. However, I am planning on posting the points for transfer only and so far haven't found a contract that can be used for only transfers.

I can certainly modify one of the contracts; however, I was hoping to find something that has been used before and generally recommended.

If you have any suggestions, I would appreciate it. Thank You.
 
Interesting. I think people often don't have a contract for transfer for two reasons:
1) it's an immediate transaction, and once the points are transferred, there's no reversing it and no risk to either party of cancellation or liability for damages
2) transfers for money are not allowed by the rules, so a contract is probably unenforceable.
 
I understand that from DVC's perspective it is probably not enforcable; however, from PayPal's perspective a contract would allow the renter the ability to dispute it with PayPal and at that point, it is the responsibility of the owner to demonstrate that they followed through on the contract and transferred the points. Otherwise, I think PayPal would give the renter their money back.

I'm not positive that is the case; however, I had one situtation where I made a purchase using PayPal on ebay and never received the item. I was able to demonstrate to PayPal that I made numerous attempts at contacting the person without any response. After PayPal didn't receive a response from the person, I received my money back.

Also, it would seem that a contract would make the renter more at ease.

However, if it is not the norm to use a contract when renting points for transfers then I'm fine with doing that. I guess it probably depends on the renter and their level of comfort.

So I guess my next question is how many people have used a contract when renting points for a transfer?
 
I received a transfer and we did not have a contract. I was comfortable with the person I was dealing with and that made needing a contract okay. We did some three way calls to MS, I paid in full, and then the transfer happened.

For me, the points were the same UY and resort as my own so I could see the points in my account. But, I also verified the transfer via a phone call.

I have read that some get 50% of the cost upfront and then the other 50% after the transfer--this way, both members have a stake in seeing that the transaction goes well.
 

I think it just makes sense for both parties to agree to what's being transfered (in writing). Email is fine, but if you don't have it written down, it's possible for there to be a misunderstanding. This is especially true with newbies who may not understand the whole UY thing.
 
In the past year, I paid another DVC member to have points transferred in to my 2011 UY and also received compensation to transfer out some our of 2012 UY BLT points. Neither time did I use a contract. Didn't think it was necessary. Both members I worked with are Disboard-ers who I exchanged several PMs/emails with, and we also exchanged phone numbers although we did not need to speak to each other. I really think drawing up a contract for a transfer would be a waste of time. Since DVC doesn't allow money to change hands for transferred points, how would you explain the money in your paypal account?
 
I've bought transfer points several times over the years, I need them at times to book bigger accomodations for family reunions. I find this is better than having to buy more points and incur more dues when I only run short once every 3 years or so.

I do my homework, I see who is advertising, I research the DVC owner by looking at their personal info, their posts, how often they post, what they post about, how long they've been at it and how many total posts they have. You can really tell a lot about a person from this info.

I've never had issues, even once when I paid for transfer points the member was unable to transfer his points since they had been banked and he just Paypal'd the money back to me, no problem. I've never entered into a contract, I've bought using Paypal (3) and a personal check (1), I judge that the member selling me the points did as much homework on me as I did on them!

P.S. Transfer points never show up in your inventory, the reservation will show more points than you have but not the points coming in!

We agree on a time, the transfer is done, I then immediately call and make the reservation, it's really quite easy but you do have to trust that you picked the right individual, like lets say a DVC expert on the DIS!
