Does your State do this?

That law is insane, it would mean my 3 kids couldn't go out to eat and sit at a table together if god forbid the 2 over 21 wanted to enjoy an alcoholic beverage with their food.
Yes they could just get a soda, but the fact that they would have to make that decision in order for their brother to join them is just plain crazy.
 
We are talking about very young adults here...
And that is probably the reason behind the law.

Much like weird signs that make little sense, like the one I saw at Popeye's in Anchorage that told people to not wash their hands in the drink machine, there is probably a story or many drunken stories behind the law.
 
So our State Driver's license and IDs are vertical for those under 21 and horizontal for those over 21 so that it is easier for bar tenders to see who is a minor. The problem is that my daughter is turning 21 and her license expires on her 21st birthday. Normally, you can apply for a renewal 60 days out and then send you a new one. Well just for those turning 21, you have to wait until 10 days before your birthday to apply for a renewal but then they said that the license can take up to 2 weeks to get mailed to you. We are flying out 2 days after her birthday and so if she does not get her new license, she will only have an expired one. What genius thought of this? They create this kind of issue for those turning 21, and I am sure that quite a bit travel for their birthday, all to make it easier for bartenders. Seems a bit silly.
I think the different license orientations is a great idea. A passport would be a nice turning-21 present for your daughter. Unlocks more advanced opportunities for travel, and cuts loose the reliance on state ID.

For a while we had some issues with using passports (or US passport cards) as proof of age for buying alcoholic beverages. The issue is that they don't contain a physical description (height, weight, eye color) as required by state law as an affirmative defense for the business that they checked a compliant ID. It was really odd because the only thing specified in state law was a US state or territorial driver license or ID, but not foreign driver licenses. And since foreign visitors at airports would have their passports, they weren't being accepted.

The law was obviously changed, but nobody really thought about it for years where passports were accepted even if the law specifically didn't allow it.

She has actually had a passport for years, but it too expired and she has to go through the hassle of applying for a new one, since she is an adult now and the old one was a child version. Everything just expired this year. We would not get the passport in time either. But we will be getting her a new one.
 
So I guess I am an atypical parent since I encouraged her to use the ID. The ID allowed her to hang out with her friends when they went out for dinner. She has spent her life being left out by others and this allowed her to go out with them. I love that you think they would not drink because she was with them but the reality it when they go out in a large group someone is going to drink. Before the ID she did sit at a separate table with the other girl who did not have an ID but it was not the same. I just wanted to show that rules are very different state to state.

If we really want to have a discussion I think that the drinking age should be lowered to 19. Trying to police kids when they come home from college is a job that I wish I was done with but they youngest is 18 almost 19 so I have 2 more years of trying to police drinking. I really think that the lowering the drinking age would help with the binge drinking that many underage kids do. The funny thing is when the kids were younger I would have never said that but now that I have had to deal with it I have changed my opinion.

My kids are overall pretty good kids. Do they do some stuff that I wish they wouldn't? Of course, but on the whole I hope that I have raised them to make good decision.

It wouldn't have dawned on me that a passport couldn't be used for the verification of age but that physical description part I guess makes sense...although I don't know a single person who has kept up with the accurate weight ;)

It was military IDs too at one time, but that was advised as not acceptable as "bona fide evidence". It's still not illegal to serve alcohol to someone without an ID (I haven't been carded more often as I age) but it's supposed to serve as a defense - that someone checked for what looked to be acceptable ID. This was where it was changed, although I'm not sure if passports were accepted before by a different law change. However, this was what removed the absolute requirement for a description other than the photo. I'd note that even eye color might not be visible because some photos IDs (like a passport card) us a black & white photo.

Section 25660 of the Business and Professions Code is amended to read:​
25660.
(a) Bona fide evidence of majority and identity of the person is a document issued by a federal, state, county, or municipal government, or subdivision or agency thereof, including, but not limited to, a motor vehicle operator’s license, an identification card issued to a member of the Armed Forces that contains the name, date of birth, description, and picture of the person, or a valid passport issued by the United States or by a foreign government.​

Yeah, the drinking culture in America is very strange. I grew up with European parents and we were always allowed to have low alcohol drinks, like wine coolers or mixed drinks that were 99% juice when we reached junior high age. I did the same with my kids and they have no interest in going out and crazy drinking. My oldest will be 21 for this trip and she is just happy that she can order the drink herself instead of me ordering it and putting it in a soda cup. Yep, I do that. And we are talking a mixed drink every few days, not drinking around the world. My youngest, who is a year younger, doesn't really like to drink. She has friends that are older and some even have parents that let them drink at their house as long as they are not driving, but she just drinks something else. I think that those years of exposure took the allure out of it and it is not something new that is "exciting" for them.
