Does 10 days to rescind start when you sign contract or when you make down payment?

I recently bought into the Poly and received a December use year. Now I am realizing that an October use year would be much better for my family. I paid my down payment over 10 days ago and already received my points and have booked a reservation, however I have not yet received or signed my deed.

My questions:
1) Has my 10 day window closed already, or has it not begun since I haven't signed or committed to anything in writing?

2) If its even an option, do you think its worth the headache of pushing the issue to get an Oct use year (Im sure that would mean cancelling my current ressie and playing hardball with my guide)? They were just selling October in March and thats when we started talks with our guide and came really close to buying but wanted to look further into resale and when we finally decided to buy direct in early April they had just changed to the Dec use year.

Any thoughts or advice would be appreciated. Thanks!!!
 
The only concern would be losing points if you cancel your October/November trips.
Your December/January/February/March trips are fine ;).

Exactly, which is why I am going back and forth trying to decide :-/ Its only 2 months but our wedding anniversary is in November, and then there is F&W and MNSSHP in October, as well as lower point seasons and less heat so I think we are going to travel often during those times. I can't see us ever traveling during the summer but we have little ones so who knows?

Just now it seems like it would always be a big risk to plan anything on our Anniversary, especially if we decide to celebrate a big year (10 year, 20, etc), save up points, and then have 2 or 3 years worth of points tied up in a November trip. God forbid if there was a hurricane or family emergency we would be out a ton of money with literally less than 2 weeks to book another trip. I almost feel like a Dec use year means we can never celebrate our anniversary at WDW without putting our points at considerable risk.

At the same time, like you said we also travel often during Christmas and Spring and Dec UY is perfect for that. I know any use year can be a bad one depending on circumstances, and we came so close to getting October but ended up with December that maybe it happened for a reason. Half of me says I should just "let go and let God" but the other half is scared to death I am not being wise and diligent with pushing for the option I think is best :(
 
Call your guide tomorrow. Ask. Can't hurt. They do want happy customers.

That said, if you're out of recission they almost certainly won't change it.
 

Call the quality assurance number that came with your paperwork. They are the people who actually work the contract and recessions, let them know that you need a different UY.

You refer to not signing your deed but that you never do. Do you mean you are having the paperwork mailed to you and haven't signed that yet? If so then you could still have things changed. If you have and are past the 10 day mark from signing then you'll have the Dec UY unless DVC decides to be lenient and make the change.

If you believe you will travel frequently in Nov or even Oct then it's worthwhile IMO to try and make the change. It's a form of free insurance against the last minute cancellation and while over the life of your contract your travel times may change you might as well get the one that seems to fit best for your travel patterns that you currently plan on.
 
If purchasing from Disney you can cancel within ten days after signing the contract for sale or after receiving all the required disclosure documents, whichever is later. Florida Statutes sec. 721.10(1). It sounds like neither has occurred yet.
