i'm wondering if anybody can tell me if my husband can handle our divorce outside of the usa? we were married in the county i live in now, but he is in nicaragua on business, and it could take a couple of months for him to return. it's a very simple, non-contested divorce. we agree on everything.
i did call the clerk's office, but was told that they can't give "legal advice", so i will have to ask an attorney. well, naturally it is friday, and i'm anxious to know and don't want to wait until next week!!!
can anybody tell me??:confused3

*former legal secretary* not sure how it works in florida, but in alabama, if the divorce is uncontested, you can send him the papers, he can sign them in front of a notary public, and send them back. they can then be filed with the clerk's office, and you'll get a court date to appear in front of a judge to get your decree signed, which will then be filed with the clerk's office, and after a waiting period (usually 60-90 days), both of you will be free to remarry.
the only sticking point i can think of will be the nicaragua part. not sure a florida court will recognize a notary signature and seal from nicaragua.

thank you, katy! problem solved! i've never traveled outside the country, so that didn't even occur to me. OP, it really shouldn't be too difficult. uncontested divorces are very straightforward.
