Disney resale restrictions, would this take the cake?

We have decided that DVC is just not for us. We love Hilton Head and I am sure we will love Vero Beach this October as well. We may even try to rent points out in the future if we find a good deal. But we will also do regular resort stays.

But with the new restrictions placed on resale buyers, my one burning question in my mind would be, will Disney ever restrict resale buyers to staying at only their home resort? I think this could be a possibility in the future. Anyone agree?

It would not be legally possible to do that.
 
I don't see how that technically would be possible even if it was legally. The system needs people to trade out of home resort so others can trade in. If you restrict resale to home resort only you are massively restricting options for direct buyers which isn't in Disneys interest. To me this is a non starter.

Disney can't change the core of what DVC is all they can do is tinker around the edges. To me as a long time owner what they have removed from resale isn't that significant. I get the people who don't own yet and haven't used it don't understand that but many owners do.
 
On another board there is some question as to whether or not DVC could (& I'm paraphrasing here) create a new exchange organization that handles non-home resort bookings.

Then all the condo associations would vote to remove themselves from the current exchange program, effectively disolving it due to lack of members.

Then DVD offers free membership to direct buyers only in the new exchange organization - so not a deeded membership, but a 'perk'.

S/he mentioned that this had happened in another TS - Bluegreen or something.

Can anyone weigh in on this. At this point this sounds like something DVC would do. I want to know if they could do it...

I guess they could, but this would make it very hard to book outside of home resort at the more desirable resorts. They need for example Beach Club owners to book elsewhere so that others can book into beach club. If they disallow this process then then it will realistically only be able to get into the less desirable resorts (SSR, OKW etc) outside of ones home resort.
 
I think that would just bounce back on them, because it would make what we always say -- buy where you want to stay -- even more important. Which means they couldn't direct-sell a Poly contract and maintain the current lie that people can "book just about anywhere at 7 months!"

Which is totally a lie and we all know it (right?!?).

Since each board of directors is composed of all the same folks, they'd have a difficult time fulfilling their fiduciary duty to their shareholders by purposely screwing some of them over. That's the type of thing that would result in lawsuits and Attorney General investigations.

I could see them doing this at the end of the time period for ownership.

Can't see DVD ever going to all that trouble. Doubt sales would increase enough to justify it.

If they did this as described above, DVD would have to pay the operating costs of the new exchange club or the members who make the exchanges would have to pay a fee. Member dues could NOT be used to pay for something that certain members were excluded from using. Not going to happen - at least not like this.

I can't tell if you're trying to play with words or not. Sure, they could restrict resale owners to their home resort. But, legally, that would result in everybody being restricted to their home resort. There is simply no realistic way to make that distinction.

I'm honestly trying to understand. No wordplay.

Several times now it's been said that this would be illegal. Something being illegal to me means that it simply cannot happen, or at least not without changes being made to the law (over which I have no control).

OTOH if something like this is possible I'd rather know about it. I'm feeling somewhat anti-Disney at the moment. Not really what's been done in the past several weeks, but how. I've never 'drank the kool-aid', but, didn't think I'd actively distrust them...

It's not rational, and I'll get over it, but even though I'm not affected by this I feel that Disney itself and a part of the DVC community sees us as 2nd class... & I don't like it.
 
IMO Disney can change the terms and conditions to fit their needs as they see fit. We have authorized the board (Disney) to vote on our behalf. If it ever went to court who would bring the case against them, who would spend the money for a couple of hundred thousand members? You would never get the "membership" as a whole to take action against Disney, most don't care. The few of us on the internet who do care can either sell our contracts if things get too intolerable or stick it out and hang on for the ride.

I have a small DVC HHI add on and bought direct b/c I wondered the same thing a few years ago. I want to be able to use my points @ WDW. Didn't bother to figure out if they could legally do it and the spread from direct $80 to resale $60 wasn't that much b/c I only had to pay $32 in closing costs with DVC v.s higher SC closing.
 
I can't see how they could restrict resale to home resort only without it seriously affecting those who buy direct as well, the current changes won't affect any direct buyers where restrict where resale members can use their points would.

Contractually it can't happen within the club but there are ways a given member could lose access. The only 2 ways I see would be if the members themselves voted to do so or if the resort (or section that person owned) ceased to be a member of the club. There are very specific situations where this could happen. But realistically the answer is it could not happen.
