Disability Service Card Issue

I posted this on the disability board, but little activity over there. Hoping this doesn't get moved.

In the past when it's just myself, the wife and kids going to WDW, we've gotten a GAC because of both my panic disorder and the disc protrusion in my back. Anyways, my MIL is coming with us this year and she's handicapped. So we were talking last night about who would get the DAS card. Brought up a couple of interesting points:

1.There will be times when she's at the park with the family and I'm not because I need to rest my back.

2.There will be times when I'm at the park and she's not because she needs to rest.

So, knowing that the person needs to be there when the group is using the pass, we just figured we'd both get one to cover us. This next part, not saying we'd do it, but it got me thinking, what's to stop me from getting a return time for Splash Mountain with my card for all 6 of us, and her getting a return time for Thunder Mountain for the 6 of us with her card, at the same time?
 
There is nothing stopping you at the moment. People have been doing that. It will probably change though.
 
There's a very easy fix to this (I would think) by using Magic Bands. Gotta imagine that's in play.

BTW, Mods - Feel free to close this. I was really just curious if this was something that had been thought of. Apparently, it has.:rolleyes:
 

I believe that this is a current loophole that a few guests have discovered and abused. But according to another website, it is known to Disney and they are working to fix it. Adding the DAS to the MB would be a good solution.

They cold always fix it the way they should have just fixed the GAC abuse - Ask for proof of disability.

Generally not allowed under I believe HIPAA privacy rules. You are mandating that a company demands patrons to provide confidential health information.

HIPAA only applies to medical personal. You can share as much of your own medical history to anyone you want.

What Disney can't do is require proof of disability for equal access because of the ADA. Disney could require proof for greater access but would still have to provide equal access without proof. This applies to all businesses, not just Disney.

Yeah, I get that. But it would seem to me, it's private property and you are asking them to provide you a service based on your handicap. To obtain a handicap license plate, you need to disclose your confidential health information.

That's just what I mean. People asking for a DAS (or as it was, GAC), were asking for "greater access".

The license plate/hangtag isn't making things equal. It's giving you something extra. That's why there's a fee for it and why you have to prove the need. The DAS is supposed to make your trip equal to someone else's; it's not supposed to be getting something better or easier than what others get. No fee. No proof can be asked for.

I may have misunderstood the question and if I did, I apologize. Its just that I don't see this as a loophole. There are 2 disabled people who qualify for the DAS in his party. Each is allowed to get a return time and bring their traveling party with them (up to whatever the limit is).

Obviously, if Disney is working to fix it, I must have missed what people are doing to abuse it. Can someone explain? :confused3

The license plate/hangtag isn't making things equal. It's giving you something extra. That's why there's a fee for it.

In my county here in NY there is no fee at all, it must be a local fee for you. You do have to include a stamped self-addressed #10 envelope with your application, signed Dr.'s certification etc.. The county office for the disabled puts your pass in the envelope and mails it to you.

Isn't this a non-problem?

If the wait time for such and such a ride is posted as 60 minutes, you present your GAC (or DAS or whatever) with the applicable stamp or icon and your come back time is 60 minutes away. There is not supposed to be a time advantage assuming the CMs at the ride are following instructions i.e. not letting you ride if you were supposed to wait 60 minutes and came back 20 minutes later or 2 minutes later.

MIL may not qualify. If she has mobility issues, she may not need a DAS. But likewise, nothing is stopping a guest with a DAS from using accessible entrances when available and also holding a DAS return time for another attraction.

The loophole is that DAS holders are supposed to only have one return time at a time, but if you have multiple DAS holders, then they're potentially holding multiple return times. It's an advantage that makes it more attractive for scammers.
