Has anyone ever experienced the seller not returning their documents by the closing date? They had to be told that they had not returned their paperwork on the day of closing (still unsure and angered why nobody was checking with the seller leading up to this point since our check has been sitting in escrow for three weeks). Still no seller paperwork yet. Just looking for any experiences, outcomes, advise or just positive thoughts.

It's annoyingly common. Here's my thread from when I bought my contract. And I had a similar frustration with the title company and agent not following up with the sellers or me.

Ours was delayed a few days, they had to send us a form to sign to extend it. Finally the sellers signed. I think they were at Disney, because they couldnt sign before a certain date. Good luck!

Often sellers see selling as a sign of failure, hard to let it go. That's why we spend big money at storage facilities to store stuff that we should have thrown away. :goodvibes

In addition sellers have to get their docs notarized which can be an inconvenience.

When we bought our sellers were from the UK. They faxed their docs but didn't mail the originals. We missed our closing date and had to have an addendum to push the date. I hated waiting especially because wour travel dates were closing in but everything worked out in the end.

I had two sellers who were great and one who was an absolute nightmare. The bad seller delayed weeks and I literally had my points loaded the day before the new UY so I almost lost a bunch of points.

If the seller doesn't return his/her docs by the closing date, does the buyer have the right to cancel the sale without penalty?

Yes. This almost happened to us. But they sent it in time and we closed prior to the closing date in the contract.

It depends on how the contract is written, often they will add a separate extension agreement. However, once the specified time has past, one can usually cancel without penalty.
