dbf and i bought DVC together, how do we get a new deed just in my name (drop his)?

don't ask... it's complicated. :rolleyes:

when we bought originally, we put the deed in both dbf's and my name.
so there are two names on our deeds, and two names on our membership.

dbf and i want to remain co-owners for our BWV contract.

but, we want to change the OKW contract to drop his name, and just have it in my name.

is this something we can do with a quit claim deed? where can i find more info about how to do a quit claim deed?
(actually, would it be better to use a warranty deed?)

has anyone ever dropped a name from their DVC contract before? how did you go about doing it?

also, if we actually go through whatever complicated process it takes to drop dbf's name from our OKW ownership, does our membership# still stay the same for both BWV and OKW?

or does OKW become a completely separate membership#?

Sounds like you need to call your guide on Monday. I'm sure they will have an answer for you.
 
You will need to get a new membership number when dropping him from the one account. You have to call member services and get paperwork (or my still have a blank to fax you). You will have to go through the "resale process" and close again. Explain your situation and Disney will automtically sign ROFR. I think this would be the same for you as what they had me do with my x-dh.

I am (sort of) protected for now, as our seperation/divorce papers state that DVC is my responsibility for payments and use, however if I were to drop dead, I imagine it would revert to the ex if he wanted it.

My understanding on name changes, is that until DVC is completely paid for (no longer making finance payments), you cannot change the names on the contract. Can anyone confirm if this is true?

Also, as Sandy said, you are basically reselling the contract with Disney's consent, but you will have to pay the money to reregister the deed with the County.

I know Disney has the forms, as I vaguely remember a magazine article about name changes due to divorce or remarriage. A call to DVC would confirm the details.

Yes you are right, I do have to pay it off now:mad: I am in the same situation. You are lucky if your x isn't executing the paperwork now to remove his name.

Ahhhhh......I now see the reaon our guide said we were smart to put DVC in just my name and add DBF as a (what do you call them again? Someone who can make and change ressies, but isn't on the contract....I can't remember the word...)

Of course DBF only suggested we do it, because there's 17 years between us and he expects to go long before I do....:(

Believe the term you are looking for is "Associate" member.

btw, does anyone recall how much the fees are to drop a name?
would we have to pay all the different closing fees like DVC $100 Transfer Fee, Title Insurance Fee, and Recording Fee?

we paid cash for our purchases, so i hope that makes things less complicated.

Actually you could do this fairly easily. I suspect DVC will charge the $100 transfer but they may not, ask them. You will not need title insurance. You will need to pay it off if not already and any fees. If you're paying monthly, you'll need to pay the rest of the year I suspect. You could do this with a deed easily as a quit claim deed or just use the info from your first deed and record it. If the other person was in charge of paying with DVC, just check that there are no surprises. If you want a deed done up, you should be able to get that done for $100. I'd say minimum charges would be the recoring fees. Worst case scenario should be around $250 if you do the recording yourself, pay for a deed and DVC charges a transfer fee. If you use a full closing service, you're looking at as much as $500.

Personally I'd go with a quit claim deed, contact DVC and get their info and contact Orange County and find out how to do the recording yourself. I can give you the EXACT info as to dealing with DVC from a transfer standpoint, addresses, fax #'s and contact info. It's really pretty simple.

An in between option would be to use an online service, which usually charges about $200 plus the transfer and recording.
