Hello

I have a co-worker who is looking to get out of his 150pts @ OKW
for only $30 a point. I have explained to him that he could easily get double that price but he says he is more than willing to let me have them for the $30 per pt.
We all know that Disney will not let this happen with the ROFR.
Any creative ways that I can get around this?

Have him put you on the deed and you pay him the $4500, plus there would be some recording fees to make you a co-owner.

Don't know what problems that could run into down the road due to the ultimate disposition of that asset. Plus, he could always have second thoughts and start using the points again.

Disney's ROFR would definitely kick in on that one if you attempted to transfer the title.
 
While there may be some "creative" ways to accomplish the transaction, there is no legal way to circumvent ROFR. The seller will have to submit the actual offer made and Disney then has the opportunity to purchase for the same terms. Unless those involved intend to falsify legal documents, Disney has the right to review the actual terms of sale agreed to in the offer and then pass or accept it themselves.
 
Doc, is it possible for him to "gift" it? We have thought about doing this in the distant future with one of our contracts. We have a dear friend who also owns points, but only one contract. We have two contracts and will leave one to our DS, but the other we would like to gift to her kids, before we pass on. Is this possible?
 

I was thinking of that as well...Gifting it.. How/Can it be gifted?

I take it that it is not just as simple as gifting it to someone and calling it a day huh?
 
I'd agree, no legal way around this unless you do some sort of Bartar or trade. If you're interested, set up a price that you would be willing to accept, say $60-65 pp, then send it through for the ROFR. If DVC takes it, he's better off and if it goes through, you have a great deal. The other option would be a cash rebate but I think that would be both illegal and unethical.
