Hi

Just finalizing our decision to buy into DVC and wondering if Disney will provide a copy of their contract for us to see before we buy?

There are so many questions I still have and would like to see all their terms and conditions before we purchase.

Is this a reasonable request.

I forgot to mention, we may buy resale. Will this effect Disney providing us any info ahead of time?

Thanks

Don't worry about seeing it ahead of time. It is HUGE and could give you a hernia just carrying it in from the mail box! With Disney, you have the right to cancel a sale prior to signing on the Mickey's and dating the Palm trees!

You will get a copy of the documents from Disney for any purchase made directly thru them. You will also the right of rescision to back out after signing the documents.

If you will be buying resale, you may need to get the documents from the seller. You will be indirectly agreeing to the contract already signed by the seller you are buying from.

I am a bit confused.

Does everyone buy without even seeing a contract?

I understand you can always back out of the deal however before going to all the work of buying, doesn't anyone ask to see what they are buying???

There is a right of rescision for all purchases made thru DVC and resale. If you want to see what the resale seller has already agreed to, it would be best to ask for the documents you will be bound by with your purchase.

When we purchased thru DVC for our first purchase, an attorney did review the documents for us. Our subsequent resale purchases used the same basic contract, so we did not have an independent review for those. I would never advise against getting a legal opinion.

Good luck!

DVC gives you a pretty standard generic contract. You won't have to worry about them slipping something in on your contract that everyone else is not subject to. All that being said I got copies of everything from my guide. Speak up - if they want to sell to you, you may suprised at what they'll send you in the mail. Ask them for a blank copy of the standard contract, the Multi-Site Public Offering Statement and a copy of the Public Offering Statement (227 pages in my 2000 edition). You'll have more info than you care to read. Good Luck.

Are you for sure looking at a resale, or have you been talking to a DVC guide?

My previous post assumes you are buying direct from Disney not a resale.

The Florida Statutes require a minimum 10 day right of recission for all timeshare properties, including resale and direct purchases. It must be plainly stated on the contract itself in bold lettering. Therefore a purchaser has ample time to contact an attorney or anyone they feel would be knowledgeable in that area. To exercise the right of recission, a letter must be written to the party who issues the contract within the 10 day period, and all escrow monies promptly returned to the purchaser.
