Contract gets to ROFR, agent tells me use year was wrong

My BLT contract got sent off to ROFR, and now the agent tells me she was just informed the use year is actually February, not September! I am furious. It is a loaded contract. I wanted to use the banked points this April and June. Now I find out they have to used by February, so they are useless to me. I am so frustrated. I’ve had contracts taken by ROFR and this one is an international seller. Is this a typical error? What would you guys do? Should I back out and start over?

UY is very important to me as we rarely, if ever, go to WDW in the summer. It's why we have a Sept UY. I'd dump it. However that might not be right thing for everyone. BLT has been a hot commodity for the ROFR lady lately and finding international sellers isn't that easy. Some things to consider:

Other than needing to use the loaded points by Feb, would a Feb UY work for you and your travel plans down the road?

Do you have other contracts with a Sep UY and wanted to keep the same membership? If so - dump it, but keep in mind some people enjoy having more than one UY if their travel patterns vary from year to year as they can use the membership with the UY that best fits their travel schedule. I'm a one membership / one UY kind of gal, but lots of people do make it work and use it to their advantage.

I'll add this. If the international seller aspect outweighs the two issues above and you decide to move forward, I would absolutely ask for a price adjustment. If nothing else, the seller needs to be paying 22 MF's.

If the contract is not what you want, then you have the right to cancel it. I would only stick with it if you can make it work.
 
Oof sorry that happened. We all joke about Fidelity because 9/10 mistakes it’s usually with them. I’ve worked with DVC store twice now and it’s usually been pretty smooth both times (still going through second one though). I would take into considering all that’s been mentioned already and see if this is still a good deal for you despite not having the extra points to use. International contract for BLT seems pretty important right now if you want a waived contract. UYs are very important to me and that would have been my deal breaker. If it’s not looking to be an ideal contract anymore then walk away. There’ll be more out there.

She also added that buyer is proceeding because they’ve had multiple properties taken by ROFR. In other words, I got a good deal, and I should let this slide.

Yes you can share your info. People usually post what they paid and additional info like loaded points, who’s paying maintenance fee etc on the ROFR thread. Are you already a member? 250 pt is a sizable contract where you can probably play around with multiple uys.
 
I am not a member. This is my first contract.

250 points, BLT, $166/point. $41,500.

2021- 250 banked, expire 2/1/23.
2022- 250 banked into 2023
2023- 250

I am paying closing of approx $1100 and 2023 maintenance fees.

Would I have any chance to sell any of the 2021 points expiring 2/1/23? They are literally going to be wasted! Those precious points, I had big plans for them, haha.

As far as future travel, I think Feb use year would be ok given that we may go in April, June or July, and December. September would have been better though.

I did find a 160 point BLT international contract today listed at $170/point… no points until 2023 though. Also Feb use year. I wish it was loaded and a Sept use year.

We have been 3 times this year and are going again in December. Right now, we are obsessed with Disney, so I think 250 points will serve us better than 160. It is at the top of our budget though. We are staying at SSR in Dec, I wonder how we will like it. I would like to have more points at a lower cost, but I really think BLT is the perfect spot for my family. Mostly for the food (amazing gluten free options in that area). We will probably rent a car most trips and drive to all the parks except MK.

If you just went to ROFR…you are looking at the potential of not being able to book something with those points until mid November to late November. …i think getting something in Janaury at that late date will be difficult.

And, until you can book, you won’t really now whether they will be of us so I’d go in with them as being lost and if you end up getting to book something, consider it a bonus!

Based on the stats you gave, I still think you have a pretty decent deal and high chance of passing with it being International seller. So without the 2021 points into consideration, your normalized price per point is about $170 (I didn't count 2023 MF in my calculation since I don't know how much that is yet). Seller is paying 2022 MF for 250 points which is nice. So is Feb uy works for you and you would prefer 250 points, I would stick it out.
 
A February vs September UY is a huge difference and a big mistake on the part of the seller and broker. You could try to negotiate a credit from the seller or broker to account for your inability to get good value from the banked points. They may not budge but they may also not want to start the process all over again with a different buyer who will certainly know that the banked points should be treated as zero value. If you get lucky they’ll give you something. If not you’ll have to decide if the contract is still worth the value as is. It still seems pretty good since you are getting the 2022 points dues-free. If you’re willing to check the site a few times a day once your points are loaded you’ll probably be able to use those distressed points to grab nights that someone drops and rent them out for $15+ per point.
 
That's too bad as Time Share Store is really good. Has OP talked to them yet about whether they should back out?

You really need to decide if you want to back out. As others have said, you probably won't have the points in hard until late in November which gives little time to rent them out. I also do not understand why the owner wouldn't have banked them before putting them up for sale. If it's a February use year they could have banked them even up to end of this month. Of course, once sent to ROFR they can't.
