Over 20 reservations but not 20 rentals. 20 reservations was simply the number of reservations before DVC would start scanning for even a single rental, at which point they considered use to be commercial. So it’s misleading to suggest DVC was fine with 20 rentals when they would lock you out for even one.

Costing DVC/Disney’s bottom line “more than the perceived benefit” [to Disney] is not the standard for fiduciary duty— it’s the best interest of the community. And “waiving the covenant” is an argument that could potentially (I wouldn’t count on it) be used by renters, but it would NOT provide a defense against a breach of fiduciary duty claim by DVC owners who are angry that they can’t book the rooms they used to get at 9 months at 11 months minus a day because they are getting snapped up by spec renters.

Not until the check-in process—BUT I agree that flagging the cc on the account would be a good way to cross reference renters vs guests— not perfect, but a good first cut if you’re seeing a different name on the credit card on almost every reservation.

We have reports over the years from owners who were contacted and told as long as you didn’t have more than 20 reservations you were fine and it didn’t matter who those first 20 were for.

DVC enforced it exaclty as it was written. Only the ones in excess of the first 20 were ever canceled.

So they have in fact allowed people to have 20 rentals…and thst is how the policy was explained to owners when asked.

Matter of fact, I think it was DVCs own actions based on how they were interpreting and enforcing that has allowed things to get to where they are.

Of course, now we wait for enforcement reports or updated rules to see if they plan to do things any differently
