Clarification: DVC Resale and Riviera Resort booking

I'm currently in the process of buying a resale contract. Disney waived ROFR on 1/9/19 and the contract is now in the final process.

Since it was passed through Disney before 1/19/19, I should be able to book Riviera Resort in the future, correct?

More often than not I won't stay outside my home resort but I want to know if Riviera Resort could be a consideration in the future.

You should be okay, unless DVC comes up with "other" resale restrictions. They don't have to grandfather any of the resale contracts at any resort, but so far have.

You did not need to pass ROFR by 1/19/19, only be submitted to Disney for ROFR by that date.
Disney has not retroactively applied restrictions on membership (yet). They always have applied the restrictions to resale purchases after the announced deadlines.

They could also take away any perks from the Direct Purchasers as well, we really are at the whim of DVC.

Yes. It just needed to be submitted to ROFR prior to 1/19/19. You were well ahead of that date.

As others have posted, you should be grandfathered in and not subject to the new resale restrictions that went into effect on January 19, 2019.

Once your deed has gone through closing, DVD will file a Notice of Waiver of Right of First Refusal. In the past, DVD inserted a paragraph if a resale deed was subject to the earlier resale restrictions effectuated on March 21, 2011 or April 4, 2016. I suspect DVD will continue that practice and annotate the Notices with language about the January 19, 2019 restriction IF it applies. In your case, your Notice should not have that language.

I suggest you keep a copy of the Notice with your deed so there are no questions in the future about your deed's status.

A few are still being filed on both gratuitous and non-gratuitous transfers. I haven't been able to figure out why some Notices are, and others aren't, being recorded.

I believe booking outside your home resort is a right, not a perk. At least with the L14.

Non-home resort booking is done through the Buena Vista Trading Company and access to the BVTC is not guaranteed by your contract.

It is with the original 14. However what isn’t guaranteed is a 1 to 1 point value between resorts. The right and membership to the club is attached to our deeds.

It is if the resort is part of the "club". It is not something they can differentiate between resale and direct. And removal from the club is listed as things such as destruction or poor maintenance etc. I guess they could just do it but "just because we want to" isn't listed as a reason in the POS.

The "club" and BVTC are two different things. Since Riviera resale purchases will only be to use their points at Riviera, they are being denied access to the BVTC. They could remove any and all of the existing resorts (for direct or resale purchasers) from the BVTC, but I DOUBT they ever would.

Not for the existing resorts. Being in one is participating in the other.

Agreed. The Club is what gives the original 14 the right to cross use at each other. This right is dictated in the POS of each of the resorts attached as the exhibit. BVTC is merely the company that is in charge of determining how it works and any rules associated with it. And the right to be in the club is attached to the deed and can not be separated.

I was thinking about this, what if for Riviera and future resorts they made direct purchasers individual club members, where the individual membership then does not transfer to subsequent owners. That might accomplish what they are saying without making the resort a club member .

Yeah, I could see that happening, then a resale owner could buy into the club as well...... at a steep price.
