My recap of Baez arguing motions:

State: The law says, in blank vs blank, it says... We object on the grounds that...

Baez: Wha wha wha...its not fair, we want to.. we need to...fair trial, I think, we think

Judge: Based on law, state wins....

Poor Baez, he can't catch a break because everything is based on LAW, who knew a trial would be based on LAW. ;)
 
well, I am leaving the thread to you very diligent people to keep me updated later......;) Thanks for keeping us so up to date....I almost really hate to leave the house at times, :rotfl:

The Defense can't do that if Casey won't allow them to. They are acting on her behalf, but must act at her behest. Obviously they can balk if she tells them she did it but she wants to say it was an accidental drowning. Attorneys cannot knowingly proffer untruthful evidence or testimony.

I agree with what you said, but I am assuming the Defense was backed into a corner because of what had already gone on in the case & Casey's refusal to accept responsibility.

Definately and I get that! Which leads me back to either the defense is inept or Casey continues to be a lying domineering witch. From all those jail house visits, I always got the impression that Casey in charge and her parents were scared of her. Could be the same here as well.

Judge just asked Jose if they asked several times if Casey is a good mother. State objected and Judge sustained. Jose says that that has nothing to do with the other. Judge says that he is asking regarding character.


Greenfield vs. state (Jose not familiar..."surprise suprise")

a lot of blah blah legal stuff from that--but used as grounds to deny the motion of the defense.

Sometimes I feel bad for the defense. They have to file motions just to get money. This Casey chick really has put people through the ringer.
 
Still trying to get those 911 calls thrown out.

Also trying to get more funds for investigations (for penalty phase, part?)

Not disagreeing w/ the opinion about Baez, but it's not uncommon for attys to be unfamiliar w/ case law citations, even really good attys.

That and the very thing he wanted a mistrial for, he was actually doing in his cross examinations.

Absolutely don't feel bad one tiny bit. I will guarantee you the $ allocated to the Defense thus far has easily outstripped the Prosecutor's budget, particularly in this economy.

You would have to be mega, mega rich, not just wealthy, to afford the Defense budget she's been allowed. Bill Gates, Warren Buffett, yes. A Kardashian, Lady Gaga, probably not. Truly, particularly in a capital murder case.
 
Happens all the time. I'd be surprised if this is a first in this trial.

I don't know if he is inept, unexperienced or if the kind of acting I see from Baez is normal. And Cheney Mason? The man can't even hear anymore. All I know is the State always seems prepared and ready to go. I realize this is the State case right now so they have the upperhand, but it was like this during the pre-trial hearings as well.

The State always seems matter of fact and competent and Baez always seems scatterbrained and out there. Even the counsel tables.. During the pre trial hearings and now, the State table is always neat and orderly. They are always ready to go at the end of the day. The Defense table , many times, looks like a mess.

Maybe Im just biased, but I would be feeling really uncomfortable with this team. The young attorneys seem more professional than the "veterans".
 
Is it just me or does anyone else remember that it was found on Casey's computer that she was doing searches on missing children's websites???

And also in the prosecution's opening statement, didn't they say that she did searches for self defense, neck breaking, chloroform etc.

She had a text on her phone from a male friend asking her to come over and she responded if she should bring the "little snot head."

I think she calculated this for a long time (a couple of months) and the look on Jose Baezs' face when the boyfriend didn't corroborate the "abuse" claim shows that he may have believed her but didn't invent the defense.

Also, the parents said that Caylee was never away for more than one night at a time. I am curious how many times did Casey stay out all night and bring Caylee with her, was it so much so that she really drugged her so she could party??? Caylee was at an age when she could tell the parents about the boyfriends and where she slept etc and I think that is a major factor for why Casey started planning this whole thing.

So much running through my mind.....

I am a bit concerned about the case the defense is trying to build. While I think Baez is horrible- I think all of his questions yesterday are trying to build a story around the duct tape-that Casey wouldn't have had access to it since she handed over the gas cans on june 24 without the duct tape and George now admits to putting the duct tape on the can when it was returned to him-so he has been in possession of the 'unique' duct tape. I really hope the state forces the issue and makes the other picture of the gas can with the sloppy piece of tape from his interview into evidence. George seemed credible-but I can see that some of his past liesto help Casey are going to be a serious question to his integrity. One of the key pieces of circumstancial evidence is the chloroform evidence from the car. If her friend was joking about it on myspace and it is something college kids 'played' with like a narcotic- I don't think that google searches can be used as substantiation of premediated murder. I agree with many of you that it is more likely that she accidentally overdosed her while trying to make Caylee sleep so she can party.

I am very curious to see if the judge allows the 'secret' to be told. The sexual abuse can be indicative of the constant lies she told and the fact that she seemed to use physical relationships with young men to belongn these groups are also similar to how a survivor would react. I wouldn't discount the abuse at this point but unless the defense brings in teachers and friends from her childhood to describe instances that made them question if she was abused - Casey would have to take the stand to make it truly believeable to me-if I were a juror.

Just my thoughts and I hope that the judge really continues to keep control of the Defense's theatrics.

Bear in mind, I'm not watching. What I can tell you is, don't be fooled by veteran attys w/ hearing difficulties -- I could write you a book, no stretch of the truth. Those old codgers usually know their way around the block, and know how to dig secret tunnels to get where they need to be. They may not be able to shoot from the hip in the courtroom on a regular basis anymore, but they know stuff.

Defense doesn't know exactly how the Pros. is going to lay down their foundation, so they're forced to scramble through their documents while it's the Pros. case.
