Carry-on

The large print says do not put valuables in checked baggage. You will probably prevail (in court if not at a ticket counter or in a jetway) that the airline must still honor your ticket as-is and use its subsequent best efforts to transport you if you refuse to surrender your properly sized laptop to become checked baggage.
 
I don't think so. The airlines reserve the right to deny passage to any passenger for any reason that doesn't violate civil rights laws, and carrying a certain type of personal property is well-established as a valid basis for denying passage. They're even allowed to deny passage for reasons that would otherwise legally be protected by the ADA.
 
Part of it depends on the type of aircraft you are flying. If I get on one of the older SPIRIT planes, I have to gate check my roll on because they do NOT fit in the overhead. Sometimes the agent will realize it when we are checking luggage at the airport and tell us the bag needs to be checked. Other times, (DEN-DTW) the FA was grabbing carryons and gate checking them at the door of the plane.

My carryon is pretty big, and it fits in all the Spirit planes I've been on...what size is yours?

The OLDER MD 80s that SPIRIT still had in their fleet. The SLOPE of the overhead won't take the wheeled rollers.

According to Spirit Airlines website carry on luggage must be no larger than 22x13x10" and weigh less than 40lb.


If you are unsure if your carry on is the right size ..it may be safe for you to pack a plastic bag or two in your carry on. If they say it is too large and you have to check it atleast you will have something to put your needed carry on items in.
 
TSA is strict about the two carryons.

I checked some airline's web sites for baggage rules regarding carry on luggage and was surprised to find this on Delta's website:

Carry-on Baggage

You can carry on one bag plus one personal item per passenger as long as it:

* Weighs less than 40 pounds (18 kg).
* Does not exceed 45 inches when you total length plus width plus height.
* Fits easily into our SizeWise® unit (approximately 22"x14"x9").
* Fits in an overhead bin or underneath the seat in front of you.


These additional items are okay to carry on and don't count towards your allowance:

* Food items for immediate consumption
* Assistive devices such as wheelchairs or crutches, provided passenger is dependent on them
* One box or bag of duty free merchandise
* A coat or jacket
* An umbrella
* One item of reading material


I found the mention of a BOX or BAG of duty free merchandise to be interesting, because such an item could be quite large.
