Canadian Passport troubles

We recently went and got all the family passports for our trip done but ran into problems with my son(who I have not yet adopted but is basically my son) first they did not like the short birth citificate so we had to order another...it did not list the biological father there but we have court papers stating that my wife has full costudy and is the legal gaurdian. The father has had his rights basically all removed since he has not contacted us in over two years and has never paid child support or done just about anything.

Even with all that my wife had to write a letter at the passport office saying why he wasn't providing a permission letter. This from a guy who is not in my sons life at all...I love how our system can hold kids hostage to deadbeat fathers. I was shocked when they told me sole custody didn't ensure you could get a passport. The lady said it may go through or we may require more to get it done.

So what would happen if you showed up at the passport office with the longform birth certificate and no court papers? The reason I ask is, a friend of mine, for reason's, didn't put her ex's name on her childs birth registration when she gave birth. Dad is still in the picture, somewhat, and when she called in regards to getting the passport, she asked if it was neccessary to get the long form b/cert if dad was going to sign the application (she assumed he would), the agent said yes, she then said that dad was not listed on birth certificate. The agent told her that as far as they were concerned, dad didn't exist. My friend got the impression that if she showed up at the passport office with birth certificate w/out dads name but with court papers and dad's signature on application it would cause a whole lot of trouble. She was able to get the passport with no problem. When she travels she has to keep the longform birth certificate with the passport, just in case.

I guess it all depends on who you talk to.

I think you would have to declare in a letter that the dad is not involved, but in your friends case I think that would be a lie and that could come back to haunt her esp if he turns out to be not so nice.

One way to fix these dead beats is to charge them with neglect if they don't take care of their kids (sad thing is we don't even want anytthing other then him to allow me to adopt...which most likely will happen anyways.) Threat of jail might get these bozos to get off their buts.

I don't understand why the passport office is putting you through all of this? Perhaps rules have changed. I had to get a passport for my daughter in 2005she was 3 years old. I had the court papers declaring me the sole parent. The dad did not have any visitation rights. I also had a copy of the regular birth certificate.

Does your court paper say the dad has visitation? Perhaps that is the problem. If the court paper says he has visitation then yes you need a notarized letter from a lawyers office giving you permission to take the child out of the country. Its ridiculous that the father is not involved and yet that court document is holding you hostage.

I'm sure it is frustrating, but, the rules are there to protect children.

You would be saying just the opposite if said deadbeat dad managed to get a passport for him, right?

Too often children are taken away from us, as evidenced by the recent news of the little girl in Ontario. A little inconvenience is a small price to pay for our children's safety.

That's interesting, last year I applied for mine and my sons passports, I knew ahead of time that Id need the longform, I put my ex's information on the passport application, he told me I could sign it for him, since he lives in Virginia, and it would have taken so much longer for us to mail everything back and forth, and I didnt have to show any letter from his father saying that he was giving me permission to get a passport... why do you need thier permission to apply for a passport?
Maybe because his father doesnt live in the country and isint a canadian citizen, I dont need permission????

I am going also trying to get my daughters passport and i have to mail the application form to him in another province and have him complete his portion and then return it to me along with a letter giving his permission to leave the country with her during the specific dates...the letter is only for the customs officers at airports, not the passport application. I also have ordered a long form birth certificate.....

i am unsure what to do about legal custody forms as there was no custody dispute as he has no rights to her and did not request visitation or anything so there is only a child support order.....written into the restraining order.......from 10 years ago but think i may take that with me to the passport office just incase they request something

The donor for my son has nothing at all, does not pay support, does not even call on birthdays (other then his own once every few years when he is drunk and feeling lonely) There is nothing then an act that ties him to my son at all. We don't even know where he lives anymore and the courts have written him off giving him no rights to the child....so why does passport canada care so much?

I understand protecting children but when you have a court order stating someone has sole custody and sole gaurdianship that pretty much shows that the child is protected by the legal parent.
