Can you switch the closing company?

Hi all,

We just passed ROFR on the 15th on a resale contract though DVCResale. We originally selected to use Magic Vacation Title and have been assigned Jessie as our title agent.

I’m a little concerned as we were just told it’ll that we should get closing docs in 2-3 weeks which seems a bit extreme. Wanted to see if there’s anything I’m missing regarding timeline AND if it’s a huge hassle to switch to another title company (Mason seems to be a good choice based on other threads).

Thanks in advance!

The time to switch is past - no one should wait 2-3 weeks for a 2 page form. I have used 3 title companies and they are all at least $200 cheaper than the one you are stuck with and got the work done in a few days.

That is a normal timeframe for Magic Vacation Title unfortunately. Though, once the documents are back at Magic Vac Title, the closing happens quickly - within a day or 2 of the documents and closing funds being in house. I don't know if you can switch at this point; so I'll let someone else comment on that.

We had to switch when the original title company our broker selected couldn't provide title insurance. I think the new title company had to send some kind of notification form to Disney since we had already passed ROFR. It wasn't a big issue, and once we switched we received closing documents the next day and surprisingly closed on time.

You'd have to resubmit ROFR and maybe even lose your deposit.

Just be annoying and it will get done. This is a form. It's not that hard.

I don’t understand why that particular title company takes 2 weeks longer than other companies take to send the pro forma simple boilerplate closing documents out - but they do & at this point they have your deposit & technically are the company you originally chose. Other than adding several days to the process, they seem to otherwise do as well as the other closing companies.
Good luck, the last stretch seems to take the longest of all, once the docs are out, then there’s the wait for the sellers to get their’s back, and after that it’s waiting for DVC to recognize you now own the points & to give you access to them - so frustrating!

While 2-3 weeks wait is agonizingly slow when you are super excited, in the whole scheme of life, it's not that long, and fairly normal for most title companies. Sure, some do move faster, but I would just wait it out. Changing title company would cost you a little extra and would require the seller to agree to it as well, since closing/title company to be used is usually in the contact. If the seller drags out the signature process and move slowly, it's gonna all even out in terms of waiting time in the end!

Great3

I had quite a few issues with Magic Vacation Title before they were owned by World of DVC. They were slow to respond and delayed my contract from being sent to ROFR by several days because they didn't send the correct paperwork. After the ROFR decision, it took them several weeks (even with me bothering them) to get the closing docs ready.

I'm sorry to see that nothing has improved.
