Can you "gift" out your membership?

I was wondering if you could give your membership to someone. I know to resell it, Disney has ROFR. And if the selling price is too low, Disney will more than likely buy it back and resell it.

Here is my problem. My sister and her family love Disney as much as I do. She is the one who convinced me to go as a single 27 year old. LOL. And now, everytime we get back from a trip, she is booking one for her family, then she gets back, and I am booking one for my family. It is like, just hearing each other talk about it, that charges the MEGA magnet that Disney has to high..and we are just PULLED to the phone. LOL

Anyway, my sister and her husband are both self employed. My sister is a Wedding florist, and my BIL is in construction..so they have had some pretty rough years making ends meet, long story short, their credit is bad. So, for them to get a loan for DVC doesn't look good.

What I have been considering is, purchasing points with my credit, and my sister will pay the monthly payments. ( I know, some people are gasping at the thought of that, but I have done this before with this sister on other loans, and she does make the payments) When the loan is completed, transferring the membership to her name.

Does Disney allow this?
 
I don't know if Disney will allow what you are asking. They will, however, allow you to purchase it with your sister as the co-owner. Then you can just let her have the use of the points and make the payments. You wouldn't need to transfer any ownership...as long as your sister didn't mind you being listed as a co-owner.

Just another option.
 
I do that with my brother - he is my associate owner - although I didn't make him pay for the points.

His family gets to go to WDW every year on my points - I know I am crazy - but they get alot of pleasure from going - and both mother and I (I am the owner and paid for everything) would pick going in studios so they can go.
 
So, an "associate" owner would be someone I could list on my membership, but Disney does not consider their credit when applying for a loan?
 

no - they don't look at their credit - this will allow her to make reservations with your membership number. She gets all the benefits - except she can't make cash reservations with the members discount - and it doesn't sound like that would be a choice anyway.
 
This is an interesting question. We own another timeshare that was a gift to us. My dad died several years ago leaving my mom with several different timeshare weeks. At first she continued to travel, taking along friends, etc. As she got older she was not able to travel as much and got tired of paying all those fees. She gave us a week at Powhatten Plantation in Williamsburg, which we trade through RCI. She also gave weeks to my siblings. She had an attorney write up transfer of ownership papers. I don't think the various timeshares had any say in it. As long as we keep up on the yearly fees why would they care? Disney could be different I guess, but aren't real estate laws real estate laws? Any lawyers out there who know? You buying the points in your name is very, very nice though. What is family for right? OHANA!!!! You meet the nicest people on the DIS..Lacee

Sounds like a great plan but please make certain that things are taken care of legally in the event one of you dies.
 
It is not an associate owner, its an associate membership, which is very different. If you purchased a DVC contract, you can't legally change anything unless the membership is paid off first, so if you are still paying for your points, you cannot give your membership to anyone. What you can do is make your sister an associate member, which means that she can make ressies by using your points. She does not receive a member card, but if she writes down the member number, thats all she needs to make ressies. She will not have access to member accounting, therefore she will not be able to find out any financial details about the contract. It would make no difference to Disney if your sister's credit is bad or not. Once the contract is paid off you can then transfer it to your sister if you wish. I have done this exact thing with my daughter's contract--due to a divorce, the contract was about to be sold for a huge loss to settle their debts as a couple. I took over the contract and made the payments, and have another 3 years until I can have the owner's name changed to mine, and I have been told the cost of that is about $800. I find that being an associate member works just fine for me.
 
DVC is different than other timeshare - you have to go through them to transfer and the buy back works against you in alot of cases.

other timeshares don't seem to care - as long as they get their maintence fees.

No thanks InstImpres - I have both a brother and mother - who I am know paying for their vacations - on my salary I certainlly can't afford anyone else!!!:rolleyes:

DVC is really strange though - when I was there this December and had guest I decided at the last minute to let them have the studio at VWL and I went to a studio at BWV - well VWL would not let them check in without me - I had to drive over and show the front desk my ID and membership card - so my guest could check in - I really feel this was upcalled - but DVC is different.

was the ressies in your name for your wlv(for your friends)
or in your friends name?


all my ressies for my father were in his name and even when i had rented from other dvc members, (now we own) had no problem.

i think if the ressies where in your name and your friends where checking in under your name, maybe thats why they had a problem.;)
 
I actually think you can "gift" the membership especially to a family member. I mean you can leave the membership in a will so what would be the difference. I have also heard of people giving their DVC membership to their kids.

I assume you would have to pay the transfer fee and give Disney a statement saying it was not in consideration for money. However, in your case what you could legally say is that you are selling the points to your sister at $84 (or whatever you pay for them) Technically that would be true since she paid all the payments! It's not like the ROFR to Disney includes a check and I don't think they are likely to refuse a contract at the going rate!

There are a number of timeshares that have he ROFR and DVC is not the only one that enforces it.

They SHOULD not let anyone check in that is not on the reservation, just add them to the reservation and they can check in.
 
Couldn't she just buy it and you co-sign the loan for her? I'm not sure if it would work--just a thought. This way she'd be the owner, and you would be involved to guarantee payment. Who knows... that might be an option.
 
Sounds like a big risk for you to take. Just rent them your points or help them rent from others.
