My wife and i are interested in purchasing the DVC membership that her cousin wants to sell to use. She mentioned that the only possible problem would be is if Disney wanted to buy back the membership. Is this Right of Refusal? If not, can someone explain this to me. Is there a reason as towhy they might not allow us to buy it? Thanks for your help.

Every resale contract is sent to Disney. They reserve the right to buy the points back for the price agreed upon between the parties. Generally they only do this if the price is extremely low. There was a post a little while back about what this "magic number" is - I'm sure someone will post it.

You can gift it without them intervening, can't you?

I am not trying to take the money away from your cousin.

I don't know it this is legal, but what if you put a higher price on the paperwork and then your cousins "gifted" you some back later. I think $62 has been the magic number recently posted.

Contact Disney.

When 'selling' between relatives they will most likely not intervene.

I 'sold' some points to my brother (Actually points that I had purchased for him in the first place) after he bought more from Disney and got his own contract number. (He originally didn't want to but the minimum required, so I bought for him and made his ressies. We did this for a couple of years)

Basically I wasn't charging him anything since he already 'owned' the points even though they were in my name.

We asked Disney about the transfer. They sent us a letter stating that I basically was 'gifting' my points to my brother and they would not exercise their right of first refusal on such a transfer.
