Can a "seller"make a reservation?

We're hoping to buy a resale within the next 60 days or so. We plan to go to WDW in Nov. After we put down the deposit and while we're we're waiting ROFR, could the seeler make a reservation for us? I figure if Disney exercises ROFR, then the seller woudn't loose the points, the only thing that might happen is we loose our reservation. If not, would the reservation be valid through the transfer of ownership?

All existing reservations are cancelled when the membership changes hands. The seller cannot make a reservation for you to use after the sale. Sorry.

I just sold one of my contracts and had to free up all points associated with the contract before the sale could proceed. In other words, no existing reservations were allowed to be in effect at the time of the sale. So I would say no, the seller won't be able to tie up points for a reservation while the contract is being sold.

No, sorry. One of my contracts was transferred from DD to me via a quit claim deed, and I had been making the payments, dues, etc. for two years before making the transfer. All ressies were still cancelled, although I really argued against cancellation on a contract I had already been paying for for two years. It just didn't seem right to me--I had to pay up the dues, too, even though they had been deducted from my checking account for those same two years. Rules are rules, no matter what.

Part of ROFR is the cancellation of any existing reservations and a block for those points on any future reservations until change of ownership has occurred. This is really in the buyer's best interest to protect from a seller using points before a transaction is completed.

But a possibility would be to rent the points that you need, then, when your contract closes, rent out your points to cover your vacation. You should (unless your use year is close to ending) break pretty even except for your time.

I recently put a deposit down on a resale of 150pts at BWV in which all the 2004 + some of the 2005 points were being used for the sellers vacation. I cannot close until after Oct vacation occurs so he won't lose his reservations. I didn't care because it was priced right and the dues would be his responsibility. I already own alot of points here so I'm only adding on for more retirement time later but it shows that the reservations would be cancelled if property were to change hands prematurely.

For those that sold, do you know at what point the reservations were cancelled. Was it when the ROFR was waived or on the actual transfer at the end?

Dean, in my case the resale agent noticed on my points report that I had used some of the points in the contract I was selling to make a future reservation. She asked me to re-allocate the reservation points using a different contract so the sale could proceed. I'm not sure if this is a policy of this particular resale agency or if it's standard operating procedure for Disney. Anyway, I released the points before the deal even went to Disney for ROFR.
