Buying Resale - Do I need an attorney?

Hello, we are considering buying DVC from a friend. We have negotiated a price and are almost ready to go (I'm waiting for my money to get here ), but once that happens, do we need to get an attorney to prepare the paperwork for us? Can we do this ourselves? Both parties live in Wisconsin and the seller is an attorney in Wisconsin, but never having done this before, we're unsure what needs to be done. Any advice would be appreciated!

If I were you, I'd hire a timeshare title company to handle the deed and paperwork for you. They cost around $300. Perhpas you and the seller could split it?

Yep, I know about the ROFR. How would I find a timeshare title company? Does it need to be someone in Florida?

Call the Timeshare Store (sponsor at the top of the page). They'll give you the number for Timeshare Closing. They handled all of the paperwork for us. Can't remember exact amount--but around $300 should be right.
They were very easy to work with.

I did a google search for timeshare title closing and it resulted in numerous choices, however it would be wise to stick with a very well known company. Is this the one that Timeshare STore uses?:

Does it need to be someone in Florida?

Yes. The property is in Florida; therefore, the deed transfer/recording, etc has to be done in Florida. It's possible you could handle the legalities yourself directly with the Clerk of the Court, but for a few hundred bucks, I'd pay a closing agent.

You might also have the seller call DVC Quality Assurance and see if there is particular language they require in the sales contract. They may have some standard contract language they want, and getting it up front will save you from having the contract kicked back.
