I applied to BA for compensation following a delayed flight in October 2012, our first WDW holiday. Never thought I would be successful but found out today I have been!! As there was four of us the comp was awarded at £480 per person!

Just to advise that it is worth doing if anyone has been on a delayed flight!
That'll pay for my next set of flights back to Florida! :)

The delay for a transatlantic flight has to be over 4 hours on landing. Ours was 4 hours 40 mins, so not even that long! The delay cannot be caused by something outwith the airlines control either ie weather.

It can also be backdated up to 6 years so worth thinking back!

Pickers I have no idea what caused the delay. The inbound flight was really late coming in which obviously has a knock on effect.

I had sent the forms away and never heard anything for about 6 weeks, then an e-mail to say they were looking in to it, probably to establish the cause of the delay, then about 6 weeks later e-mail to confirm it was successful. I honestly thought there would be some reason why we weren't entitled and I had also geared myself up to try and negotiate some AVIOS instead, but no need lol.

My DH could't believe it, when I told him I was going to apply for the comp he thought I was nuts and said there was no way they will just pay out. Therefore I should definitely keep all the money and do with it what I please!

Haha i assumed they d be able to wriggle out of most delays being their fault!
 
It's always worth pursuing compensation in the event of a delay but just so you know, if the flight was delayed for a technical reason (e.g. if there's a fault discovered before the flight), BA and most other airlines are refusing to pay compensation pending the Supreme Court judgment in the Jet2 case. If they refuse to pay you out, keep hold of all the correspondence and an eye on the news (you'll know when the decision comes in because it'll be a big item).

Fortunately (touch wood) I haven't been hit by delays but my family has and I've got compensation back for them. There are good templates on Which? and Martin Lewis's website (which gives you good examples so you can see how the process works and how much you should claim for).

We had 3 claims and got the 2 out of 3, the 2 virgin claims were pretty easy with one paying out within 3 weeks of receipt and the other after 2 follow up letters and took about 3 months. (3rd was thomson flight and after getting the CAA involved we still were denied)
Cant complain though we got over £3000...

Well done.

Air France have been consistent in their poor customer service and not offered appropriate compensation.
Looking at raising this is a small claims court action.
 
Yes well done. I had a BA flight delayed by 30 hours back in 1998. Two years fighting and all we were offered was air miles which were unusable. I just gave up in the end. Appalling customer service at the point if delay and after. They also tore two expensive suitcases. Zero compensation for that as well. I have never and will never fly with them again. Not even if they are giving the flights away.

Reid, we were delayed a few years back with AF for over 5 hours! We have fought and fought for compo but to this day they state they will not budge - we referred to to the French authorities and they didn't even reply! Apparently the original problem was a member of the aviation crew (baggage handlers we think) smashing a set of stairs into the side of a flight which caused a huge knock on effect of delays over the day (so they knew about it in advance). In addition, because the scheduled crew went over their hours, they had to get a standby crew in, who quote "got stuck in traffic in Paris", leading to at least an hour of the delay :headache:.

To this day AF still deny and state it was a 'technical' failure!! We are watching the Jet2 case and will pursue again should it be successful. It is simply not good enough that airlines can worm their way out of compo by stating 'technical fault'.

We even looked to use a company who specialise in airline claims. They said we were entitled to compo of which they would take their fee. However, once we read the small print there was no way we were going to sign up with them. There were clauses about paying for barristers fees if needed etc. And when we queried this as meant to be 'no win, no fee', they said it was a standard legal contract and those areas did not apply to our case and just to 'sign it anyway'. Needless to say, we didn't bother! :scared:
 
I applied last January following a 20 hr delay with Virgin in 2009. I had to go as far as raising a court claim with Northampton Bulk Handling Centre (using Money Claim Online for £70) and despite declaring their intention to defend - 3 weeks later Virgin sent me a cheque for £2100!!

(Having recently been made redundant that money made our 2013 holiday possible!)

Better still, another DisBoards member contacted me to say they were on the same flight and were also able to get their money - I sent them copies of all my letters and having paid me they could use this as part of their claim.

I have claimed from Ba for a 5 hour delay last year
My experience has been awful too. The customer services department told me recently that the compensation department do not have a telephone! We are definitely entitled but I wouldn't have claimed it had their customer services been even a little polite or apologetic. I don't really believed in claiming. However, the delay resulted in out of pocket expenses of over £200 for me.
I've also been offered some air miles but as I intend never to ever fly BA again, they are no use to me.
I have now put a claim onto the small claims court on the advice from the Civil aviation authority.

How interesting! I once had a horrific BA experience (my last!). I was flying to FL connecting through Atlanta I think it was... anyways, the BA lady at the checkin counter rebooks me stating I had an "illegal connection." She then sends me through Dallas (!!!) with just as little time to connect.. maybe 15 min more... and then I proceeded to miss my flight at that airport because I had to go through customs. I missed two flights while in customs to be exact! By the time I made it to Florida it was almost midnight and a good 5+ hours later than my original planned landing time! I actually had to call with the super expensive plane phone to tell my friend I would be even later than the first planned delay!

It was horrific and I wrote BA customer service to complain but no one ever answered. :confused3 I have since never flown with them again and I fly frequently!

Wondering if I should try complaining again...
 
Oh crap! I just checked and it has been more than 6 years by two months!:faint:
 
We have just put a claim in for Virgin after having an almost 6 hour delay. It was my sons wish trip and we had such a magical time but poor communication and planning meant we were stuck at the airport with one set of food vouchers which were no good as all the outlets closed leaving one sandwich shop in the whole of the airport. My son has sensory issues and won't eat cold food and we were worried we may not have enough nappies for the delay which meant a trip in the taxi to get him some food and nappies to last the duration. These things happen but it could of been dealt with better. It was down to a technical delay but the plane had the same issues after a previous service so not holding my breathe but worth a try x
