I went to the DLR today to sign the paperwork for my Aulani add-on. I hadn't really looked at it in depth prior to meeting with the quality control lady and was very surprised to see DVC is going to charge a fee if you decide to sell your points. There will be a fee of $250.00 for DVC to review the contract and decide if they want to buy back the points. I hadn't heard anything about this so needless to say I was not expecting that. I don't know if this has been discussed here (I may have just missed the thread) but this may be the wave of the future.
 
I noticed it on my first read thru of the million page disclosure. There was a mistake on the docs and we needed to call customer service. They asked us to be sure and understand the resale charge. They didn't give a reason as to why, but there is most definitely a cost to run ROFR on all those contracts. They obviously decided not to take a loss on that in the future!

Thanks for the heads up...wonder if/how this will affect resales at all in the future?
 
maybe it is also to discourage people buying small contracts as add ons, taking a trip to Aulani and then putting it on the resale market.
 
There are probably several reasons why Aulani's ROFR fee is higher than the fees at the DVC resorts located at WDW. One factor might be that all of Aulani's Notices of ROFR, deeds, etc, will be filed and recorded by Hawaii's Bureau of Conveyances. The HBC probably charges different amounts for its services than the Orange County Comptroller (OCC), which services the WDW resorts. HBC's fee schedule is at http://hawaii.gov/dlnr/boc/fees. Fees and expenses can change based on the State. If I remember correctly, closing costs for HHI are higher because the State of South Carolina requires that an attorney be involved in the closing process. Perhaps someone from the TimeShare Store can correct me if I'm wrong.

When we bought a resale AKV contract through TSS, our paperwork showed that the seller paid a $20 ROFR to Disney. $20 is probably lower than it should be since OCC charges $18.50 to record a Notice of ROFR.

Wow. That is interesting. At one point Disney was charging sellers $200 (I think it was from 2005 to 2006) to sell a contract and then someone challenged Disney saying it wasn't in the paperwork. Next thing you know Disney no longer charges that $200 fee but a $20 ROFR and a $50 Estoppel fee. I guess they decided they better put the fee in the paperwork from the beginning this time. I am sure when The Timeshare Store, Inc.® gets call in the future from Aulani sellers they won't be happy to hear about the $250 fee assuming they had forgotten about that since their purchase.
