A mother in New York is suing an Applebee's restaurant after her 5-year-old son was allegedly served a Long Island Iced Tea instead of apple juice.

Pereles said she did not realize her son was drinking a concoction of white rum, gin, vodka, triple sec, Coke and sweet-and-sour mix until it was too late. The boy's eyes became glazed and he began to laugh uncontrollably, according to a report.

"When you're looking at your 5-year-old and you're asking him, quiet down Seth, sit still and you see that mentally and physically he cannot comply with what you're asking him to do because he is under the influence," Pereles said.

I'm sure it was an honest mistake by the Applebee's employee and I don't blame the mother for being angry, but is this situation worth that much money. Yes the 5 year old could have been hurt because of all the alcohol, but since he wasn't is suing for $75,000 really neccesary.
 
only if it was a scalding hot long island ice tea with a flimsy takeout styrofoam lid ;)

What's next. Someone goes into Wendy's gets a papercut from the tray lining and gets a lawyer involved.

I first heard of this on David Letterman just before he went on his top 10 involving applebee's. He was saying it was served in a sippy cup.

Typically in these chain restaurants, they have separate kid cups with lid. How precisely does one mistakenly serve an alcholic beverage into a kid cup?

I don't see how it was an "honest" mistake. It appears negligent for the opportunity for that mistake to happen to even exist.
 
The article doesn't say anything about that other than he was served the alcohol.

Just soliciting clarification.

In my experience with my 5yo--most chain restaurants do have children's cups.

They order pineapple juice quite a bit which has to be fetched from the bar and as of yet--they didn't mistakenly get a rum runner. :confused3
 
Maybe it wasn't an honest mistake and the kid was being a holy terror in the restaurant and they wanted him to be quite :rotfl2: . :drinking1
 
I think we all agree that Applebee's messed up one way or another, but is it really worth suing for $75,000 when the kid is ok. Ok fire the employee if they did it on purpose, but how is suing for $75,000 going to change anything.
 
Suing for money is a little excessive, but I would definitely make sure I got free Applebees for a VERY long time! I loooove Applebees.
 
Exactly, she deserves some kind of restinution because of this, but not $75,000.

I'm having a hard time believing the kid drank more than one sip. There are four shots of different liquors in a Long Island Ice Tea. And the 5 year old liked it enough to keep drinking it after one sip?????
 
I was also wondering about a 5 yr old drinking that. That is one strong drink. I don't know a 5 yr old that wouldn't turn his/her nose up at it and say YUCK.
 
Similar thing happened to us at the Holiday Inn and Suites in Ocean City MD last year. We were poolside and a waitress took our order for lunch and drinks. I asked for 1 virgin pina colada for DD and a regular for me. A little while later she brings out our drinks. She hands DD hers and me, mine. I start to drink mine and see DD drinking away at her drink. She says it really tastes better then the last one and she looks very happy! I take a sip and it is the real thing! A 6 y/o has just had quite a few gulps of a pina colada. I find the waitress and ask her if she realized she gave a real colada to my DD and she freaked. She was truly upset. She apologized and brought her manager over to speak to me. She felt really bad. I told her mistakes happen and luckily DD didn't drink much. It never crossed my mind to seek damages. Some folks are always out to make a buck.

I was thinking the same thing!! I mean... I can drink like a champ, but put one of those things in front of me and I'd better have already had a few of something that tasted good first! :drinking1

I can't believe they are suing for $75,000. That's an insane amount of money for a mistake in which there wasn't really any harm done.

I also have a hard time believing that apple juice looked like a long island! LI's are darker than apple juice. And if it WAS in a sippy cup, that's just ridiculous that someone could make a mistake like that. How often do they mix drinks and pour them in sippy cups anyway?! :confused3
 
Never had one but I heard they taste just like ordinary iced tea. (That is what I was told--I hate iced tea, so would never order one).

I don't think it was an "honest" mistake. The child was disruptive and the drink was served ( I heard on Howie Carr) in a sippie cup.
