Anyone been convicted of DUI after only one drink?

There is a difference between a drunk driver and a legal driver who had a drink. The problem is the line has become blurred.

NO ONE SHOULD GET DRUNK AND DRIVE but there is absolutely nothing wrong with having a mixed drink, a glass or wine or a beer and driving if they are NOT IMPAIRED. This "zero tolerance" attitude towards a legal, and might a remind you, highly taxed product makes absolutely no sense. It's unfortunately that your husband was the victim of an irresponsible, intoxicated individual but to say that anyone who has a drink and drives is equivilant to that is wrong. .

The point is, there's a difference between a drunk driver and a driver who has had a drink.

But there's a movement afoot in this country to make them one and the same.

I don't think anyone is saying it's okay to be DRUNK and drive, but that it's okay to have A drink and then drive. My personal rule is that if I'm driving, I only have one drink, period (and dont' have drinks like Margaritas or Long Island ice teas, which may come in a single glass but are NOT a single drink!). After that I switch to diet Coke.

I usually stick to red wine. The alcohol content is predictable and based on volumn.

Well, I pointed out about a page back that I HAVE had someone close to me die in an accident. It doesn't make me feel any differently. Anymore than I would stop hunting (and I don't hunt anyhow) if someone close to me were killed by gun.

Anyhow, I responded to that comment only because I was told, and I quote, "Bite Me." Nobody has the high moral ground here. Many of us who have no problem with drinking and driving have had terrible things happen in our lives at the hands of drunk drivers. They are not related.

And frankly, I get the sense that even froggy knows she's wrong the way she's fighting back so hard. It's emotion, just misplaced emotion.
 
Wow, I must admit I try to avoid debates like the plague. I for one agree one drink will not make you impaired. I have not met anyone that was charged with a DUI over one drink. I have had one drink and driven home, alone, and felt fine. That was a long time ago. I mean no dis-respect to others and their veiws. I have seen Frog's web page where he goes into detail about the horrid day, and I admit I cried, alot. I am sorry if my comments seem childish, this is why I stink at debates, I follow my heart not my head. Have a great night all!

Remember, the police don't convict you. They can arrest you, but it is then up to the DA to charge you and a judge or jury to convict you.

If a cop violates your rights, you have a legally provided remedy - you can file a lawsuit.

Yes, after reading this whole thread, this is becoming quite apparent!

I can totally understand the sensitivity of those who have come face to face with drunk driving, and I am so very sorry for what they and their loved ones have been through. But from a logical perspective, those drivers were DRUNK, they were not drivers who had had a little alcohol but not enough to impair their driving. It just doesn't make sense to lump anyone who has had a drop of alcohol pass their lips in with someone who is clearly impaired. The two are not comparable!

Just out of curiosity now, I wonder how many cases have occured where it was CARELESS driving that caused the accident (the kind of careless driving that even sober people do regularly), but because the BAL of the driver was a bit above the limit, it is automatically assumed that the alcohol contributed to the accident? I am sure it has happened often enough.
