Another ebay situation - please help!!

I understand that you feel uncomfortable about this auction, but the time to decide whether or not you want to buy this item is before you bid, not after. If I were the seller, and a buyer told me (a) I didn't notice your payment requirements until after I bid, and (b) it turns out this isn't what I wanted after all, I would not be willing to cut you any slack, and you'd be on your way to a big fat NPB. I'm not saying that you *should* pay him. If he's suddenly getting a lot of negative feedback, I'd be leery too. I'm just saying that since the responsibility was on you as a buyer to check these things out before you agreed to buy the item, you don't have a legitimate "out," and you should prepare yourself for negative feedback and an NPB. The exception would be if his description is wrong or misleading. Did he claim or imply the games were new?

Not at all. MOs and cashier's checks are so easily and frequently forged that no experienced buyer would ever treat them as cash.
 
I agree, the time to ask questions was before you bid. He has no obigation to work with you against his TOS. You sound like you have buyers remorse. I suggest you offer to pay his listing and ending fees (why should he have to be stuck with them), and skip the purchase.
 
IMHO use of an ordinary credit card (not a debit card or check card) is perfectly safe for this transaction.

If you pay by credit card and no merchandise at all is delivered, you may cancel the transaction even if the seller is not in your state or more than 100 miles from you.

Hmmm, it sounds to me like you just don't want to buy this? I have to say, and I am sorry in advance, but I would be soo annoyed if you were my buyer. The TOS were in the auction and you asked a question without getting an answer and bid anyway. Don't pay if you don't want to, but I would def be leaving a NPB for this type of situation.
 
I'm not sure what you think he can do with your checking account number, but he can't do anything. I've had European buyers who wired money into my checking account, because that was the easiest way for them to pay. They were not able, in turn, to withdraw anything from it.

You could still end up with a negative but at leat you won't be out $160. I agree with other posters who say your questions should have been asked before you bid, BUT it sounds like this seller purposely worded his auction in a way to avoid saying whether the products were new or not. Sounds like a fishy deal to me.
