Hello,

Does anyone know our rights as a buyer after broker had to make repeat ammendums to our contract? The first one was a simple buyer name misspelt but the second one revolves around a specific request we made that we are now being told after signing that cannot be met. Our contract was signed over a month ago so I’m more than a bit annoyed we are being told this now.

There are two parties to any contract. They must both agree for it to be valid. You can refuse to accept the amendment.

The contracts are all pretty boiler plate, this isn’t like real estate where everything is negotiable.

I’m curious to know what your unworkable amendment is.

Week 47 fixed week. We wanted to ensure we’d be able to use it in 2025 as it’s at the end of the year. We were told it shouldn’t be a problem. A month after signing we were told it is in fact now a problem and we will have to wait till 2026 to use the fixed week.
 
Well, that's probably correct, because the transfer may not happen in time for the 2025 fixed week to be booked. The broker can't make Disney change their policies, and any reservations the current owner makes will be cancelled.

Shouldn’t they have known that though? That’s what I’m pissed about. I know it’s all true and factual but I bought something essentially under false pretenses.
 
If the terms cannot be met, and the contract included them, you have two choices. You can go forward with the purchase anyway, or you can walk.

It is possible that if everything had happened more quickly, it would have been done in time. You are right on the border for that.

Either way, it is one year out of many years of future ownership. If this were definitely the week I wanted long term, I'd go ahead with the purchase. You will still have those 2025 points, and can probably use them to book something else. But that's just me.
 
You could ask them for a concession. It sounds like an honest mistake, but I don't see why should should have to eat all the value of their mistake. Ask them to pay for half the dues for 2025 since you aren't getting the full value you had expected. At this point, I'm sure they wouldn't want to put the contract back on the market.

Since there really are not many FW contracts out there for sale or have been sold, I can see how they may have thought it would work differently.

But, I do agree they should have confirmed it before assuming.

If you have the “shouldn’t be a problem” in writing and you haven’t closed, I would refuse to close. You’ll need to talk to an attorney about whether you’re entitled to your deposit back; no one here can help you with that.

Disney likely rejected the contract as is prior to issuing ROFR waiver.

If it’s a material issue for you, you should seek a reduction in price that makes you comfortable with the risk.
