I quit my job in August, after my maternity leave was up. My boss failed to "terminate" me in the system so I kept receiving my salary. I called my company's HR department multiple times and they drug their feet on correcting it. I did this before I even got paid!! I could see the pay-stub online and knew I shouldn't be getting it so I called them.

I called my boss about a week ago to try to get her to push HR along. They told her they'd already corrected it and yada yada yada. I got nothing from them, though. Then poof! I got my W2 and assumed (I know, I know.. I shouldn't have assumed) that it was for the correct amount so I filed our taxes.

Today I get a letter from the company saying that I owe "xxx.xx" and I am to pay it immediately upon receiving the letter (don't even get me started on that ) and they'll send me an amended W2.

Sooo...the point of my angry rambling is to ask if I have to file an amended tax return when I get the amended W2?? I have zero experience about anything like this and the lady on the IRS 1800 number just kept saying it was up to me. That doesn't seem right, though...

I used TurboTax and would have NO idea how to go about filing an amendment.

well if you will owe more taxes or if your refund would be smaller you have to file an amended return

which turbo tax program did you get the deluxe program should be able to help you with an amended return

Look for the Form 1040-X. When you find it, first fill in that it is for 2009; this will populate the information in Column A. Then replace the W-2 information in the program with the correct information. Everything in Columns B and C will automatically populate. You will have to put a few items in manually, these are the amount ppaid with the original return or the refund received, and an explanation of why the changes were made.

The 1040-X must be printed and filed manually, you cannot e-file it. Note that it is a good idea to wait until you know the original return was processed before you sumbit an amended return.

Did you refund the company their money each time they over-paid you? If so, then you should not owe them anything.
