Am I being unreasonable? Ebay ? UPDATE #27

A backpack without straps is nothing but an ugly, uncomfortable throw pillow. She probably found it at a yard sale or something and thought she could pass it off as if it were supposed to be that way. I hope you get your money back!
 
Oh, and I like how she says that straps are a feature that's apparently "important to her", like the rest of us wear our backpacks on our heads like hats.
 
The item appears to be brand new so I am guessing that either she bought it at a deep clearance price BECAUSE it didn't have straps, or that she bought it for herself or someone and then got home and realized it didn't have straps so figured she would just turn it around on some other sucker.

I have just escalated this to the Ebay CS level. My response:

"The seller has made it obvious she is not interested in coming to a resolution and I am not going to go back and forth with her over semantics. By her own response she listed the item as a "Backpack Purse". A Backpack Purse has straps so it can be worn as a backpack. I did not tell seller that I "assumed" it would have straps, I told her that a backpack purse is "expected to have straps"-- so it can be used as a backpack. The item has the obvious places where the straps are supposed to be attached. Seller should have clearly stated that there were no straps or should never has used the term "backpack" in her listing-- the item was misrepresented and her description was misleading. Contrary to what she says in her response, I am not upset with myself, I am upset with her and the item with a major defect that she sent to me. "

Thank you for the quick shipping on this. The actual bag is very nice, However when purchasing a "BACKPACK Purse" that is listed as not having any defects it is expected that it will have the straps with it. That is really a major thing to leave out of the item description, particularly when you only include a photo of the front of the bag. I am not happy with this.
 
Maybe you should tell her you're thinking of sharing your wonderful experience buying from her with about 200,000 of your closest friends :cool2: .

But yeah, she knew what she was doing, it was a deliberate act.

That is a good question, didn't think of that. I ordered a Cinderella dress off eBay the other day and the person only had a feedback of 4. It was 100% positive but it made me nervous. I looked and she had a bunch of costumes and DH reminded me everyone has to start at zero so hopefully it will be fine and if not we paid with Paypal so they will handle it, but I did hesitate for a minute with the low number.
 
UPDATE!

Well I escalated the claim and within 10 mins I had an email from Ebay that my money has been refunded, including shipping! :yay: Apparently I am not unreasonable to expect my backpack to have straps! The money is already back in my paypal. It says in the Case File:

Neither you or the seller were found at the fault.

Does this mean that they don't actually take the money from her but just make us both happy and cover the cost?

It doesn't say anything about having to return the item? I would have thought that I would have to do that first? Does this mean I get to keep my new lunchbag/throw pillow/hat? ;)

She had a lot of sales--over 3000. I had checked her feedback (I always do) and it was overwhelming positive and looked at the last 12 months: the neutral (Item and shipping was fine just no communication-- doesn't bother me, I don't need to talk to you, just send me my stuff) and I think one negative where she responded person never paid and they mutually canceled. Seems like a "professional ebay seller"-- thus she REALLY should have known better.

HOLY MOLY that went down fast!!

I just won an auction an hour ago, one bid , red ralph lauren boys shirt in like new condition.

Seller immediately sent me a note when it ended saying "sorry I don't ship internationally. "


She lives in Kentucky and I live in Louisiana. :rotfl:

I am hoping she just misread, but in my gut I have a feeling she isn't happy with the 8.99 sellling price.

I paid immediately with paypal and let her know I in fact do live in the United States. Interested to see how this goes down.

At least she has a perfect rating.

I bought a red Vera Bradley backpack that was advertised as new and from a non-smoking home.

1. It REEKED of cigaratte smoke, not just a little, really bad
2. It was NOT new. I have this backpack in two other colors and could easy tell that this bag had been used. It even had a small stain on it.

The seller denied everything, but did give me my money back immediately.

I am totally surprised at how fast this was. Case was opened at 9:24 and closed at 10:26. I guess at a small amount of money it isn't even worth ebays time to put much thought into it. It was a litle less than $15 total but when she responded in such a ridiculous way I knew I had to make her night a little less fun.

This auction is for a very nice & clean black nylon & brown suede bakcpack style purse. This handbag has at least a helf dozen zippered compartments, organizer pouches, key fobs, mirror, credit card & ID slots, etc. All in one functions 9 x 10 in bag. That person knew exactly what they were doing. :rolleyes: It's that very type seller that causes people to be reluctant to bid on things they'd really like and can't find locally. A shame! Hope your outcome is positive!

That is amazingly quick. I guess Ebay is working hard to clean up their image. So many have been frustrated and turned away from Ebay - sellers and buyers alike.

I've sold on Ebay many a time. It's all about full disclosure - the good and the bad. She purposely left that little tidbit out of the auction and then to play dumb is simply unacceptable. It gives sellers a bad name.

Give her negative feedback. This is one time where it's completely warranted.

I think so. I was looking into their Buyer Protection thing out of curiosity after the case was closed last night. I am actually a bit annoyed to find out that it looks like she didn't even end up losing the money nor will this count against her Seller Rating. So other than her just getting a little cranky with me, she suffered nothing. :mad: I did leave negative Feedback but I am sure she will reply with her own spin.

Looks like Ebay is just paying these out of their own pocket, and probably especially since it was so little money. But that stinks because she was wrong and should have to pay the consequence, and by Ebay taking the hit that means everyone suffers with higher fees. Sellers can still suck but as long as they keep the transactions cheap they can probably slide by.
