We've been travelling to the US for the past 10 years and made the decision that DH wouldn't declare his conviction (he was in quite a bit of trouble just over 10 years ago) and he's never had a problem, the US don't have anyway of checking unless they really wanted to.
If your really going to worry I would apply for the visa.

I've read this on other forums too, including people who have been in prison managing to get into the US on an ESTA despite their conviction not being spent. I actually find that concerning!

However, I think this thread is generally very reassuring to people who have been arrested when they hadn't done anything or had convictions at a young age. I know I got myself very worked up worrying by looking at websites where people were sAying "I got caught shoplifting when I was 14 and now I'm on a lifetime ban to the US" etc but happily, I guess that isn't the case!
 
Hello, we are it a similiar situation, my OH got arrested about 13 years ago for urinating in a shop doorway sent off for the police certificate came back with no convictions, phoned the courts up for a copy of the court report could't be found on the database, the lady at the courts said we would't need a visa because it was't moral turpitude so phones the us embassy who said anyone who has been arrested whether it led to charges or not should apply for a visa, told them that both the police certificate and the court report came back blank and said to apply for a subject access statement from the police if this comes back negative as well then to take all the paperwork to the embassy for the interview and do a sworn statement. Was told that visas went from 3 months to ten years and would't say what the chances are for a 3 month visa. If we was going on our own I think we would just chance it without the visa but we are taking our 5 and 2 year old and could't cope if OH got sent back home but its a pain with nothing showing up. We had approved estas and yet had denied access at orlando due to lost passportswe bad a few years back, i know its not the same but def go for the visa on safe side. We thought we was all ok yet our 2 year old twins could enter but not us and took a while to sort out in the officers office, not a nice start to any holiday

Fingers crossed it all comes back ok
 

My husband has a ten year visa for a juvenille offence (fight at school unfortunately)!!

The process was ok and the Belfast Embassy were lovely to him - probably because he really didn't need it! It was before ESTA - first trip and I was worried. Really wish we hadn't as immigration are always surprised it is for so little.

Anyway, no that we have it I really don't know what to do about renewing it!! We are now on their system but could honestly answer ESTA questions in the clear. Suppose it is bettter to be sure but nuisance every ten years. Thankfully we have five years left!!!!

He will be fine but good luck through the process.

Same as us here. DH was arrested and fined for being drunk and disorderly 23 years ago and he applied for a visa, got a 10'year one no problem and it is up for renewal in a couple of years.

4 immigration people have been really surprised when he told them what it was for and have told him it isnt needed. They said it was a way of the UK embassy making money - they might be right but is it really worth the stress wondering id the next guy at immigration would say he did need it?

He is not risking anything and is going to renew it, and hoping for a 10 year one again.

Same here. I was arrested in 1972 for being drunk and disorderly.


Before I went to Florida in 2001 I applied for a visa and was granted a 10 year one. When I arrived in Florida a guy at immigration asked me what the visa was for, when I told him he said that I did not need it. The same thing happened in 2009 and I was again told I did not need it.


Just to be sure I renewed it in 2011 and was granted another 10 year visa. I thought it better to be safe than sorry seeing as I was already in their system.
