Adding someone to the deed

I am one of the New Yorkers who were crazy enough to fly down to WDW to buy into BCV before the points went up in price. Of course it made no sense for my wife to go and pay two airfares, so I am the only one on the deed.

My question is: What is involved in adding her to the deed and what kind of expense are we talking about. I do all of the vacation planning, so this is not a high priority, but I would like to add her eventually.

first off......

disney has the ROFR on any changes to the deed....

they do have a form that you can have emailed to you from disney that outlines the procedures....( am in the same boat, the day we signed , well i signed, she did not have her identification with her...

some where i have the name of someone who can do the "deed thing" for a reasonable cost.....basically, he just does the leg work with Orange County to have the name placed on record ( which means recording fees etc )

will try to look this up for you and that reminds me, should get going on adding her name too
 
If all that matters is in the event of an untimely death you wish for your wife to be on the deed,don't worry about it. In Florida they have what is call right of survivorship. If you die she automatically gets the property. At least this is what the title company told me when I wanted to add my daughter on my first contract. You may want to ask your title company. ROFR will not come into play in this situation. You will need a new deed and new recording. You should be able to get by for around $150 or so. Just add her as an associate member. She will get everything except a membership card.
 

Can my two son's names be added to the deed, making them members rather then just guests when they use our points ? This would allow them to purchase park passes at the DVC discounted price and would also make passing the deed to them upon our death much easier,( not that I'm anticipating being dead before 2042, but one never knows for sure).

Yes, see my post above. I'd just add them as associate members as long as they're adult ages.
 
I just wasn't sure if the deed could have more then two names on it. For the deed, what is legal age, 18 or 21 ?

Disney only has ROFR on sales, if it is a deed change to add a spouse or delete an x-spouse I am told there is a different procedure and an automatic waiver of ROFR.

I should get my paperwork from them in the next day or two and would be happy to share any info.

Both DVC contracts are being deeded over to me;)

actually, i believe according to the Multi-Site POS, your sons can indeed take advantage of the perks and discounts that you normally get.
that is, unless you charge them for staying on your points.

from the 8/2002 version of the Multi-Site POS, on page 47 of the booklet:
Home Resort Rules and Regulations, Section IV. Member Benefits and Privileges, Paragraph 3. part 2)
"When a Club Member uses his (snip) Points to reserve Vacation Homes on behalf of a non-Club member, and the Club Member does not charge any rental or other fees to the non-Club Member for the reservation, the non-Club Member is eligible for all or some of the Club Member privileges and benefits that a Club Member would normally receive during his stay (snip)."

i'm not 100% sure how to interpret the wording "all or some" though.
 
When I added my daughter to the contract the legal age was 21, but now it is 18. I am not sure which age DVC uses. We added my son when he turned 21. We were down on vacation and met with a Disney rep. All the papers were signed there. My mother was taken off and my son was added. I think it was about $200 or so. The deed can have 4 names on it.
 
Merilyn, did you have your son with you at WDW when you added him to the deed, or can you do this by mail with a notary? And who do you go through to do this, your sales rep? Thanks!
 
In March my DS stayed on my points. The confirmation letter was in his name. He had my membership card with him,but they would not give him the UPH pass discount he was not the member.
 
KNWVIKING, hm... i don't know what's up with that, but i wonder what they would've said if your son had brought a copy of that page out of the Multi-Site POS with him.
i don't know how we would go about verifying what the official word on the UPH discount is, but wouldn't you interpret that paragraph i quoted as meaning that in your son's circumstance, he should have been given the discount?

in any case, Dean's suggestion of adding your sons as Associate Members would solve the problem.

it does kind of make you wonder though...

How would they know if I rented these points ? Seems like a strange statement for a legal doc that doesn't require proof of the ressie details.

I guess the word "some" is their all encompasing exclusion clause.

Would be sort of cool to whip that page out on an unsuspecting CM next time it happens and demand clarification.
 
There are a couple of discounts restricted to the DVC member themselves. They must be staying in the room to technically qualify. These include the member cash discount and I belive the 10% UMP discount though they haven't enforced the later obviously.
 
You guys are way wrong on this one. The rules changed about adding someone to your deed a couple of years ago. For me to add my Wife to our 3 deeds, I must have all my mortgages paid off. Then it's a matter of paying the state and county tax for a transfer of the deed to the new owners (Me and my Wife) and title insurance if you do it through DVC. The reason for this is that DVC is now selling our mortgages and the company buying them needs paid off before a new owner can be put on the deed. This does not mean that you can't put someone on as an associate member but the associate member is not on the actual deed.
You can do a quit claim deed through Orange County Courthouse, deeding it to both you and your spouse and save the title insurance money but not the tax money, if it's not mortgaged. I don't remember how ROFR factored into this since I would have been retaining ownership but adding my wife to the deed as a joint owner.
I wanted to add my wife but couldn't since the rules about the mortgage changed. Call member accounting, they can explain it better. I think Karen is the woman that sent me my original paperwork to do this. I held off because of the tax money that was due and when I was ready, the rules had changed.......spruce
 
That's true, if there's a mortgage involved you will need the lender's (owner of the mortgage) permission to change the deed. Does anyone really finance DVC, LOL?
