I am not the type of person to make a big deal about my Muscualr Dystrophy. I figure I have it, I have to deal with it, and I want to be treated just like everybody else.

Well, I have been employed by the same company for well over 13 years. I like the company I work for, and I love (well like my job very well). I got a new manager last December. She seemed ok, but was a real whimp and only looked out for herself. I have my neurlogist fill out FMLA (Family Medical Leave Act)papers every 6 months because that is what my company wants. I had them filled out on July 29, and they were declined because i didn't meet the 1250 hours per year. I was disscussing this with my manager and she told me I was no longer protected and I could be terminated. I just about hit the roof! After 13 years you are telling me something like this? She made me so mad I told her to go back to her desk and sit down because she wasn't helping me in this matter and I would take care of it myself. I also told her I was not protected under FMLA I was protected under ADA, which states "anything that is a reasonable accomodation"

Well, I was s*&% full of her and took her to human resources. We had a meeting, and even the HR rep told her anything that was a reasonable accomodation. She didn't get it!! Well, last week we had a meeting with my Department Manager and he said he didn't understand that after 13 years something that works was no longer acceptable. Well, me and my manager got into it big time. I pulled some things on the internet about ADA before I went to my meeting. She told me I was being hostile towards her and I said "and" then I shoved the papers under her nose and told her basically you can't touch me.

This all stems from when I miss a day of work due to my MD it has not been counted against me as an absense. Now my manager wants to count it against me. I basically told her that if she tried to do ANYTHING to me I would have every attorney in Columbus on the doorstep. I am pretty sure everything will be ok, but I guess the days of trying to "hide" my MD are over. I guess I am not like everybody else and these laws were made for people like me to be protected from idiots like her. I will keep you all updated as to what happens.

Your post was not a rerun for me. The only person who will stand up for you is YOU! Sounds like you have kept it pretty factual & that you have the law & facts on your side.
 
All I can say is good luck to you in dealing with someone who obviously doesn't get it.
Here's some Mind expanding Pixie Dust for your boss and some Calming and Relaxing Pixie Dust for you (although you might want to throw some of that on your boss too). Sounds like she might need some before you throw the mind expanding stuff on her.

Is not having an MD event not counted as an absence something you negotiated or is something covered by law? I had never heard that . Every time I miss work due to an MS flare is counted against my sick/vacation time. It isn't counted against me in my yearly review though. Is that what you mean? Your manager wants to penalize you for missing work? She is clueless. I've long exceeded the FMLA limits but no one at work ever mentions it to me. I hope things settle down for you.
