My husbands home of record and legal residence is Fl. We are temporarily residing in Texas. In the past when residing out of state due to Army, we have used the FL resident rate on the cruise by showing an LES, which is a federal tax form showing our state of Residency. This time DCL returned it to travel agent asking for a different type of proof. We have now submitted a servicemembers affidavit, which is basically a legal form that is notarized and lists Fl as our state of residence with a Florida address. Waiting to see if this is approved, cast member we spoke to seemed fairly positive it would. But curious if anyone else has been in this situation and if there was any type of military form they had luck showing. Thanks in advance for any assistance. Hoping for some Disney Magic...

As I recall (and I'll preface this by saying that the rules may have changed between 1994 and 2001 when this last applied to me), I changed my residency from Maryland to Florida when I was stationed in Orlando. In order to maintain myself as a Florida resident, I had to maintain a Florida drivers license. So while I lived in South Carolina, Washington, etc. I had a Florida drivers license. Florida law was that as long as you had a military ID, you could keep driving on an expired Florida license (although I got lucky one time when my sub pulled into King's Bay, Georgia and I was able to run across the Florida border in a duty van and get my license renewed).

If you gave up your Florida drivers license, then you may no longer be a legal resident of Florida. (Yes, your LES withholding may still be FL until you file a new residency form with them, and I'm assuming that you are still filing taxes as a Florida resident (i.e. no state income tax for military). But if you got a new driver's license, you may have technically ended your out-of-state military residence status. (Technically the LES doesn't show your state of residency, it shows wherever you have listed for state withholding. 99.99% of the time, that is one and the same.)

Another way to check if you are still legally a Florida resident: Do you still vote in Florida by absentee ballot? If so, then you are still a Florida resident and maybe your Florida voter registration card might help convince DCL that you are entitled to the Florida resident rate (even if you mistakenly gave up your Florida drivers license).
