I found this ebay auction. Seller is pretty confident it will pass ROFR. If it doesn't pass he will pay $300 to buyer for time/trouble. Right now its around $57 a point for 150 pt contract. No way it will pass ROFR....

"Disney Vacation Club does have the right of first refusal for this time share. They have not been buying these back though. Disney has not exercised this option at all over the past few years.

This is my personal timeshare. Feel confident that this purchase will go through just as smoothly as it would if you used a broker, because a professional closing company will handle the sale. Upon the deposit being made for the timeshare, I will forward all information to the title company and they handle everything from there. You Will get your deposit back if Disney did buy it back. I will also send you $300 for your time if Disney exercised this option. I feel confident they will not."

Maybe he is actually looking for a ROFR and figure giving someone $300 will be fine if necessary. Probably by the time he paid commission, etc he would break about even, just looking for someone to be on the line in case it actually goes through.

But...his reserve price = $58/pt.

He better hope the bidding picks up or he's going to be out a bunch more than that $300.00.

:confused3

I think its sad for the buyer who thinks they're getting a great deal, and then end up with nothing. well $300, but still....

Boldface is mine. Can't imagine where he ever got this idea....:confused3

We've had numerous reports on the DIS over the years where buyers lost out because Disney ROFR'd. Just look at the ROFR thread here on the DIS. There was a SSR March 2008 UY that was ROFR'd at $83/point. Several other SSR's ranging from $79 to $82. An SSR in the $60's/point will definitely be grabbed by Disney.

$58 per point will never make it thru ROFR.

Right...as the OP pointed out.
Easy $300 for the winning bidder.

Disney takes the points for $58/pt.
Winning bidder gets $300, but no points.

Seller is out points for big loss and $300.

Seems pretty foolish. The difference between $80 a point and $60 a point is $3,000, more than commission would cost him. I wouldn't be surprised if he has a "shill" bid in his back pocket if it doesn't go up.

What I see is the seller wanting the cash up front and not delivering on the goods.

I see a scam in this, not a seller who is going to be bought out cheap by Disney.

I think the seller got it really cheap. I saw a similar ebay ad approx. 2 months ago, that was written very similar. (Disney hasn't ROFR in years) The first ad said Disney CAN'T ROFR this particular auction because it was purchased thru some special situation that I can't remember. (divorce, death, bankruptcy, etc.) I made a thread about it prior but can't find it. So my theory is seller picked it up dirt cheap thu the special circumstance, and is trying to sell it for anything and recoup his "investment" thru ROFR.

EDIT: I found my prior post. It was bankruptcy court with NO ROFR.

The quote above is from the persons "feedback", if you know anything about buying stuff in Ebay this should send up "red flags" all over the place.

Actually not really, he has 220 positive feedbacks and only the one negative (although it doesn't help that it was the last transaction).

Still think he is just uninformed and thinks that worst case scenario he gets ROFR'd and still gets out of the contract. Probably can't get anyone to put up the money to even send it to Disney.....obviously needs the money!

EBAY has many unscrupulous sellers. I am sure there is mention of a deposit that you will probabaly never see again. BUYER BEWARE, If It looks to good to be true, it usualy isn't!

Actually, 2/220 is a damn good feedback rating. I would buy from this person. Maybe not this item, but something I wanted... sure.

Hmm only $66 per point. It will be interesting to see the feedback after Disney ROFR's this one.
