2-year old broken arm at daycare

:hug: to your little niece. Accidents certainly do happen but the act of lying (I feel)is never an accident. :(

So sorry to hear this. The accident is seemingly forgivable, but the lying? Shameful! Please keep us updated.
 
Step #1-Cease all communication with daycare. Step #2- Do not talk about this publicly, and especially on social media like Facebook. Step #3-Call a personal injury attorney. There is such a stigma out there about lawyers and people being "sue happy". Lawyers are professionals that are there to give you advice and help you in times like these.
 
I work in a child care centre. If this happened where I work, that teacher would immediately be transferred to another room until the investigation was over. After the investigation would prove the teacher was at fault, the teacher would be fired immediately.

I am very shocked at the reaction of the owner. This would NEVER happen where I work.

I am happy CPS in involved.
 

When my oldest was in daycare as a newborn, one of the workers lied about a diaper change for another child. BY LAW (don't quote me on specs), they have to check the babies every so often and there was a place to note. The worker noted that she changed the diaper.

I was told about it since my child was in the infant room and it will make sense why in a moment....

Being a new mom (my daughter was 10 weeks at the time)--I was wondering how the mom knew as I was wondering about my inability to detect this lie about a change.

In an odd coincidence, the mom had received a sample diaper on the mail and for whatever reason, she used it that morning. When mom visited over the lunch hour, the baby was wearing the same diaper which was the only one of that type she had. The rest of her stash was different. When asked, the worker insisted she changed the baby. When asked by her boss, she insisted and she was then told about the unique diaper. The worker then said it was dry during the checks so no need to change.

She was fired.

The boss told me that had she come clean inmediately, no big deal they could retrain her. But the fact she would lie over a diaper and directly to the mom and held to it was a bigger problem. Because, what else would she lie about.

I'm not as concerned that an accident happened that broke that little girl's arm. I am more concerned at the lengths she went to to evade the truth by lying for 3 days that she had anything to do with it at all. And I am appalled that the daycare is trying to make mom feel guilty by saying their heartbreak over an investigation is even on the same level as a toddler with a fractured arm.

They are more worried about not getting busted and more worried about themselves.

That tells me, they know EXACTLY what happened.

The lady running my daycare took a diaper change lie more seriously than your neice's daycare is about her injury.

And I want to note, I don't think the mom requested a termination--the daycare realized how egregious it is for a worker to lie about the care of a child.

Your niece should never go back and I would update CPS about what they are saying. It makes me wonder if by chance they are hiding other things. It smells quite fishy.

So sorry about your niece's arm and I hope she heals very quickly.
 
Since CPS is already involved, and assuming your niece has good insurance coverage, I wouldn't immediately go to a lawyer. It sounds like "nursemaid's elbow" and it happens. It's horrid, but it isn't necessarily a sign of abuse. So now that CPS is investigating the daycare, I feel like I'd be reassured that the other kids there are safe, which would be my primary concern (once I got over the initial insanity, of course) And as long as I wasn't out of pocket for a lot of money, I wouldn't really see the point in any lawsuit at least until the CPS investigation is over (depending on what they find and how it's handled)

As for the lying and coverup - I would absolutely be telling other parents and no way would my kid return there.

Nursemaid's Elbow is not a fracture. I had one child get it frequently. The arm is completely unusable and the pain terrible until corrected. I haven't known any child to ever come across as being okay with that.

The lying is a huge problem though.
 
I am interested to know why the teacher isn't being charged with neglect?

Even if we assume the incident occurred in an unavoidable way the teacher a) injured a toddler b) did nothing about it while they were in pain c) then lied about having any knowledge of an injury

They should be fired, and I am surprised that they aren't being charged with anything.

If the incident was innocent why did they not come forward immediately.

I agree, they all covered it up, there is no way that a toddler with a broken arm would be acting normal for the rest of the day. That place needs to be shut down, its pretty clear that the kids are not in a safe environment there.
 
They knew she was hurt when it happened, but may not have honestly known she was in pain afterwards. When dgd fell, she cried out. She didn't cry again until they set the arm. But she DID hold it funny so it was obvious something was wrong.


OP, you said that CPS is involved, is that who licenses child care centers in your state? If not the licensing agency should be involved also. In this state the two are not the same and the Childcare Licensing Agency actually gets more done as in caregivers fired, license revoked, or whatever is deemed appropriate. CPS can't do all of that here.
