13 Year old gir declared brain dead has now officially died

Just heard, Erik Munoz named his unborn daughter Nicole.
 

My hope is that Jahio has passed away and is buried and her family continues the charade to make money.
That would be more palatable to me tha Jahi still being attached to machines.

As far as the Munoz family is concerned....thank God that Marlise got her wish and that we did not continue to use her as an incubator for a severly handicapped child.

That would then be fraud and a violation of the agreement they have with the Alameda County Coroner's Bureau. In order to get them to release the body, they agreed that once they had exhausted all attempts to keep the body functional, they would hand over the body to the coroner to perform an autopsy.

The death certificate is considered a public record since this is California. By now it should be possible to order one. Here's Michael Jackson's, along with the amended version that included the findings of the toxicology report:

Marlise Munoz's husband and mom were on AC360 tonight. Anderson asked if the hospital was going to bill him for the time she was on support. He said he is still getting bills and understood that they were going to keep billing him. I am not sue person, but I would be if I had to deal with that.

Most definitely I would be doing the same. ::yes::

Hope he finds a good council who can help him navigate this crazy thing and at the end of the day he can mourn the loss of his wife and daughter. :sad:
 
My guess is that the bills are generated automatically. I can't imagine he hospital pursuing collection in this case.

I can't imagine the hospital not being able to stop the automatic billing, the last thing the family needs to deal with is seeing bills, kwim?

In his case I think is have to be talking to an attorney.
 
Someone actually has to think. . . .you know, realize the implications . . . to stop the billing.


I don't think Munoz is looking to sue the hospital for anything, but if the hospital actually tries to collect the amounts billed, they open the door to a second round of litigation on all those pesky end of life issues.

Interesting. They've dismissed the federal court action without prejudice, meaning they left the door open to refiling.

You can voluntarily dismiss a case for a number of reasons. I could speculate, of course. But considering that the federal court was going to defer to the state court, it seems logical to withdraw the federal court action.
 
Interesting ... there is now a case in Canada where a brain dead woman is being kept going on a ventilator. She was 22 weeks pregnant when she suffered a cerebral hemorrhage on Dec 28th and died. In this case, her husband is on board with keeping her body going until the baby is big enough to be born. The doctors are shooting for 36 weeks.

There would be no out of pocket expenses for this or practically any other kind of "medically necessary" in-patient care. The province of British Columbia does charge "health care premiums" unlike some other provinces. The current individual rate is $69.25/mo for anyone with a family income of over $30,000/year. Obviously, as throughout the rest of Canada, most health care costs are borne by the public through taxes.

I imagine it must happen far more often than we know because it's not really newsworthy to anyone that's not directly involved. I've been following the discussion on the allnurses board (from a link earlier in this thread); there's lots of anecdotes discussed there that are similar but yet never publicized. It seems to be the appeal for funds that took the case you're mentioning public and of course the legal action and the resultant jockeying for public opinion that brought the McMath and Munoz cases forward.
