Hi guys...
Bad day here. I just picked up my kids, and less than 1/2 mile from my house I got in an accident. I was stopped at a busy intersection, waiting to make a left turn at a red light. My light turned green and as I eased out, it was too late. We had already collided. He was headed straight on that road (IE if I were turning west, he was headed east).All I can figure is he tried to beat the yellow? I am so mad at myself because I just can't believe that I had an accident. Thank God no one was hurt! I had all 4 kids with me. We all had our seat belts on. I drive an Expedition. The front grill is ruined. He drove a Plymouth Neon...the passenger side of his car is scraped up and down and dented at the point of impact. I fee lreally guilty, because once I realized that we had hit, the first thing I did was angrily point to my green light. I didnt even think about the fact that he may have had a passenger ( he did not THank God) I think I was just still so stunned that I had actually just gotten into an accident. I have been driving for 14 years with no accidents...THe police took our statements. I told the officer just what I told yall. The other guy is claiming he had the green light also, he said he saw me coming out and decided all he could do was gun it? Then, when the officer asked him for his insurance he said he just applied for it, and he didnt have a card?? Oh man....oh man I am still shaking. I just can not believe this has just happened. I do not even know what happens next. I tried to call my insurance agent ( I have had State Farm for 9 years now) but they are already closed for the day. I left a message with their machine....I dont know what to do next..the police officer said since we both are claiming the green that it will be up to the insurance company....how will it be determined who is at fault?

Hello everyone. Another day gone, and one more day closer to the cruise. Kristin, I haven't thought about dresses yet. I want to try to lose some weight also. We are going to Disneyland in the Spring. I hope to lose it before then. I am a little ashamed to admit that I have purchased some things for the cruise though. I've been reading some of the other threads to get some ideas. I bought one of those over the door shoe hangers (everyone seemed to recommend that), a clock that has lighted numbers, a kit to make my DD a Disney Princess autograph book, a disney character pillow case for character autographs and I bought some of the magnetic strips to make door decorations. I know...........it's way to early to be buying things, but I have a huge closet and I am just so excited.

I have starting buying stuff too!!! I just made a huge purchase and bought an underwater housing for my digital camera - whoo hoo!

It will be alright. It's always scary when you are in an accident and it sounds like the guy who hit you is a real jerk.

You did the right thing. Contact your insurance company. Your adjuster will contact his (if he had insurance at all) and they will try to negotiate a settlement. If they are unsuccessful, they will hire you an attorney who will file a lawsuit on your behalf. But again, don't worry. Your insurance company will do all of this for you. That is what insurance is for.

Just hope that he did in fact have insurance. If not, your insurance company will get stuck with the bill. In our state, the other drive would then get charged with driving without liability insurance and here that means a $500.00 fine and a 30 day loss of license. Every state is different as to the punishment for no insurance.

Were you hurt? If you are having pain anywhere in your body, do not sign any releases for the other driver's insurance company or for your own until you have been checked out by your doctor. You may sign away your rights even to medical treatment, according to the law in your state. Sometimes, injuries do not surface for several days after an accident occurs. This is very common with whip-lash type injuries.

Otherwise, I hope you are alright and you are able to get this matter resolved quickly. Like I said every state's laws are different, but I will answer any questions I can and maybe be of some help.

About my anneursym....I was sitting around and all of a sudden it felt like my brain was swelling aqainst my skull and my whole neck and back muscles felt pulled out and my hearing also went as if I was on an airplane...my ears popped. I called my aunt who is a retired nurse because I am 6 weeks into a new job and dont have insurance yet. This all happened on the friday of labor day weekend. My aunt told me it sounded like a migraine and with no insurance...she said she wouldnt rush in just yet to a hospital. I stuck it out with motrin til sunday because I had to work sunday and labor day and knew I would need a doctor note to skip work so I went in Sunday night and the local hospital was trying to brush it off as a migraine as well. But one doctor was a little worried how quickly it came on not to mention I had vomited as well that Friday night so they did an angiogram where they puncture your groin area and force a camera up the artery to the head and take pictures. They noticed blood around the brain and saw the anneursym. They transported me to Newark University Hospital where they performed surgery immediately to clamp off the blood pocket. I remained in ICU for 2 weeks with all sorts of pressure being put on my head hoping no stroke, seizure or death occurred. Lucky for me I am home and alive. The doc said I am lucky that didnt kill me....most people dont live through a burst anneursym. Thanks for your concern. I will be 100% on Sept 16th 2006. Heck, I am ready now!!!! Lets go!!!! I am a single mom of an 18 year old son. He was diagnosed with cancer at 15 but has been off chemo since Feb of this year and is doing wonderfully. Keep in touch...:)

by the way...i am sorry about your accident...i hope you are ok now

Tracy, I am so sorry that you had to go through all of that. How are you doing now? I had an aunt who had a brain tumor that she did not know about and it burst one night and she did not make it. I realize that what you have suffered is different, but you are very lucky to have caught your problem in time. I wish you good health from here on.

Wow, I'm glad you're all okay. Our last accident was right before Christmas a few years back. We got sidewiped in our little Saturn by a guy in a huge van. Our dd had nightmares for weeks. Our ds (who was almost 3) thought it was great fun when the car when careening sideways, then up onto the curb. Such a boy.

All you can do is tell the truth and hope it comes out your way. They didn't talk to any witnesses? No one stopped to help out? We always stop if we witness an accident, but maybe we're just nosy.

Sounds great! Technology and I do not mix well. I do have a digital camera, but I confess that I usually just use my 35 milimeter that I am so comfortable with. My use of the internet is even limited, or at least by all my friends' standards. Until I started looking for a way to meet families with children who will be on our cruise, I had never participated in a thread like this or even corresponded in any way with anyone on the internet other than general e-mail. I had planned to buy a couple of those disposable underwater cameras for my DD and myself. Mayabe I should consider just learning to use my camera. I didn't even know that they made underwater housings for them.
 
Tracy - what an ordeal for you! I am so glad to hear that you made it through so well and that you are recovering. We'll have a toast to your good health on the cruise next year!

Amanda princess: - I am soooo relieved that you and the kids are okay. Isn't it amazing how quickly an accident can occur? Thank goodness no one was seriously hurt and I hope that no injuries show up as time goes on. I am sure State Farm will take good care of you and that it will all work out.

DD5's eye is finally improving. Still have to return to the pediatric ophthalmologist on Thursday but hopefully he'll be satisfied with her progress and we can just finish with the meds.

My sister and I are going to see "Wicked" the musical on Thursday. We have season tickets to the musicals here and this is the last show of the season. I have been listening to the soundtrack for weeks and I am beside myself excited about finally seeing the show!

Only 9 days until we leave for Disneyland - yippee!!!!

Our kids are more tech savvy than we are, but we love our digital camera. I didn't think I'd use it because it has all these weird settings (see, I haven't used it right yet) but it's GREAT. The benefit I see to it-- you can get rid of all your loser pictures right away. That way you have no surprises when you get the film developed and have five or six of your thumb per roll. We never use the regular camera anymore. My biggest problem with the digital is that I'm a terrible procrastinator and I don't down load the pictures right away, and I did end up losing some of our vacation pictures from last year, almost all of the pictures from Saint Augustine, but none from Disney or our Halloween cruise.

THanks for your words guys. SO far so good, no one is complaining of hurting. My car is driveable, everyone who has seen it, that knew about the accident says that it is much better than they thought. I am still waiting to hear back from his insurance company. My company (State Farm) really did not seem to be much help. I called my agent on Tues, he gave me a claim number and the number to call about it. When I got them, they said that I needed to decide if I wanted to go thru them ( and be out my deductible and they would help me try to get it back from his company) or if I wanted to go thru his company 1st, in which case they are out of it. Is that right?
 
PS I am headed to WDW next week, does anyone need anything?(good thing I was already planning on not driving my vehicle there)

Yep, this is pretty much how it works. I can tell you, if he is trying to say that he had green and you ran a red, his insurance will almost certain deny the claim. I have never had an insurance company pay under that situation. Maybe you will get lucky though. As long as you do not sign a release for your insurance company, you can go back to them if you have no success with the other guys company. Kentucky has a two year statute of limitation. You may want to see what your state has. However, if you are talking only a property damage claim, surely you will not want to let it linger very long so statute of limitations probably will not be an issue for you.

I'm glad to hear that everyone is alright. Property can be replaced, people can't.

I am so jealous. I attempted to get a trip to WDW planned for November. November 15th is DD's birthday. Work didn't allow for it. I have to plan vacations months in advance to pull them off. I hope you guys have a lot of fun.

Since we are both claiming we had the green ( i know i had it dang it!! GRR) are you saying that neither of our ins. cos will pay for the other's damage?? I am confused. What is the point of INS then? It just bothers me, that once again, I am going to get messed over.I was stopped at the light for a good 2-3 mins waiting for it to turn green. Why would I run a light after I had already been there patiently waiting??? I got a copy of the accident report today. A guy I work with used to be a traffice officer. He had told me yesterday, that had he been the responding officer he would have written the guy a ticket, because A) he was pulling out of the drive of the gas station, and people pulling put of private property are supposed to yield to people already on the road and B) because he told the officer he saw me moving into the intersection, but felt like all he could do was gun it. He also said that usuall, the reports lists driver one and driver 2, and usually whoever is driver one is at fault. I am listed as driver 2. BUT he also said that since the officer did not give out a citation, that probably the ins cos will pay each other, and we will both have to pay our deductibles....

Again, I stress that every state is different, but I am going to bet that your friend is correct. Since the officer would not rule on fault, your insurance company is going to proceed as if you are telling the truth and his insurance company will proceed as if he is telling the truth. This means that they each will deny the other's claim. This will force you both to turn it in under your own insurance costing you the deductable. They will then litigate the matter between themselves and most likely each will end up reimbursing the other. This is only going to occur because you are dealing with a property damage only claim. If either of you were alleging personal injury. The insurance companies would treat this matter the same. It would result in lawsuits being filed by each of you and a jury would decide fault and award damages. But in a property damage only claim, it is cheaper for each of your insurance companies to go ahead and pay for the other's vehicle than it is to fight over it. Court costs and attorney fees to litigate will be more than they will pay out to fix the vehicle. It's not fair, but it cutting your losses and going on. It's done every day in the insurance industry.
 
All of our paperwork went to China yesterday, so baring any catastrophes or world wars, we'll have our daughter with us in time for the cruise.
