Calif. Woman Spanked at Work Sues for $1.2M By JULIANA BARBASSA, Associated Press Writer

Lawyers for a woman who was spanked in front of her co-workers as part of what her employer said was a camaraderie-building exercise asked a jury Wednesday for at least $1.2 million for the humiliation she claimed to have suffered.

Janet Orlando, 53, quit her job at the home security company Alarm One Inc. and sued, alleging discrimination, assault, battery and infliction of emotional distress.

Employees were paddled with rival companies' yard signs as part of a contest that pitted sales teams against each other, according to court documents. The winners poked fun at the losers, throwing pies at them, feeding them baby food, making them wear diapers and swatting their buttocks.

"No reasonable middle-aged woman would want to be put up there before a group of young men, turned around to show her buttocks, get spanked and called abusive names, and told it was to increase sales and motivate employees," her lawyer, Nicholas "Butch" Wagner, said in his closing argument.

Lawyers for Alarm One, an Anaheim-based, 300-employee company, said the spankings were part of a voluntary program to build camaraderie and were not discriminatory because they were given to both male and female workers.

"This is being done for one reason and one reason only — money," said K. Poncho Baker, the company's lawyer.

Alarm One officials ceased the practice in 2004, the year Orlando sued, after another employee complained of being injured, according to court records

Oh my God, who would allow that to happen to them?? This is crazy...Any company that told me i had to do that, i would walk right out or laugh in their face...
I can't get over the fact that she (and others) participated...stupid... :sad2: :rolleyes2

That's one funky team building exercise. Not exactly what went through my mind when I saw the title :blush:

I saw this the other day on an episode of the tv show "The Office"...

thot it was absurd, odd, and sort of funny...

little did I know it was pulled from real life.

I didn't think you could have an assualt AND a battery charge for the same person... I thought assault was when you physically injured somone and battery was the threat to do so. I can see if it's charges against separate people? Maybe it's a different state law? Any lawyer, police, paralegals out there want to clear this up? It's something that has always bugged me...
 
I think I would need a lot more information before I victimized the victim further by saying she "volunteered"; she could have "quit"; she could have "walked out"; etc.. We really don't know why she was involved - what kind of threats were made against her if she didn't participate - if she had 6 kids at home that needed to be fed and clothed on her salary alone - or if she had a critically ill child or spouse that was relying on her health insurance..

It's one of the most degrading things I have ever heard of in the work place and if she had a legitimate reason why she felt compelled to participate, she deserves every penny and more..

This sounds like a college frat hazing...not a team building exercise.

Good point. No one really knows the story.

It's so easy to say she should have just said no, or should have done this, but we don't know the repercussions. Anyways, it's not always that easy for some people.

And come on, do you really think they advertised "COME TO TEAM BUILDING FUN -- GET SPANKED, HUMILIATED AND ASKED TO WEAR A DIAPER AND EAT BABY FOOD YAY!"
 
I HATE team building excercises. They are freaking stupid and I refuse to particpate in anything that requires me to do something I wouldn't normally do--climbing ropes, falling backwards expecting people to catch me.

I had a great boss a couple jobs ago. Her idea of team building was "Everybody stop what you are doing, we're going for pizza and bowling." And off we would go in the middle of the day--let voice mail pick up the phones. :thumbsup2

THAT was fun "team building" and a great stress reliever. I guess that's what happens when the boss has a PhD in psycology and was a recognized expert in employer/employee relations. :sunny:

when my mom became a chief in the navy--they had to do an initiation.

While no spanking was involved--I have no idea why ithe "initiation is allowed.

With all the sexual harassment stuff out there--I wonder if it is still practiced today.

(I mention only b/c of a task she had to do which didn't harm her in any way--but doesn't have it's place in the military).
 
I spent one day at a team building seminar at work. We did do logical things but I was at the height of my panic attacks. It was horrible for me. Even though I had a very understanding employer ( I would recommend him to anyone! :goodvibes ) I still felt compelled to participate. It would have been obvious I was not there and the directors of sales and human resources told us we had to be there. So I am NOT a fan.

FYI - I believe ( but don't quote me ) that battery is touching someone without their permission. I overheard a doctor in the ER talking to a patient on the phone. He said, "If you tell me not to do something and I do it anyway, that would be battery. And I will not behave that way."
 
You know, if someone wanted me to wear a diaper and spank me in public for 1.2 mil, I'd be the first in line!!
 
According to the company lawyer, that program ended in 2004.

It took nearly 2 years for her to work up to filing a lawsuit??
