Beyond that, this was a relatively recent change for National, so we might see the others follow-suit in the months to come. Remember, the rules that apply are the ones in effect at the time you pick-up your car, not the rules that were in effect at the time of your reservation.
Also, I think MG in the original post stated that his Avis contract had changed, and that he had actually checked current Hertz and Budget contracts and they had changed as well. That was the only reason I said I would check into National, because their old agreement that my husband signed with Emerald Club states the provision for valets.
As far as liablility goes, I knew someone who lent his car (not rental) to his sister and she got in an accident. The people she hit came back and sued him for damages and medical payments - that's why I thought I might still be held liable. I don't know that they got anywhere with their lawsuit though as I lost touch with the vehicle owner.
