W2 question

My mom is asking me and I thought maybe somone could give some info.. She works for a security guard company.. they changed hands in March.. she has her w2 from March thru December .. The problem is the company she worked for in Jan- March was broke into and all their records are gone.. They wrote a letter and mailed it to her telling her to get her paycheck stubs from Jan- March and take them to her cpa so they can give her the info.. Can they do this?? She obviously needs her w2 to file her taxes.. Does anyone know what can be done? Isnt this their responsibility? another problem is she has all her paystubs but the last check in Jan shows her ytd paid.. then fast forward to her last paystub in March.. The ytd is less than what it shows on the Jan stub..
 
I'd have thought it would be their responsibility too, but I'm no accountant. I always thought you had to have the W2s to file. I'd call the CPA where she intends on going to be sure before I'd want to start paying $ when they might not be able to help. I'm sure they'd be able to answer that type question over the phone. I'd hope so anyway.
 
Thanks for the reply.. I advised my mom again the same thing..she's going to call tomorrow to see what needs to be done..

If you don't receive your Form W-2 (PDF) by February 15, contact the IRS for assistance at (800) 829-1040. Also, you may want to refer to Tax Topic 154, Form W-2 - What To Do if Not Received, to see the specific information the IRS will need in order to prepare Form 4852 (PDF), Substitute For Form W-2, Wage and Tax Statement, or Form 1099R, Distributions from Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc.
 

Yes, you can do that. You do not have to have your W2. However, something does not smell right here. Have your mom check records w/ TWC and Social Security Admin. The company had to file quarterly forms w/ both places for payroll taxes.

Thats what I thought too.. After I talked to her I found out "the story".. she actually is working for the same company for the whole year, but they changed cpa's at the beginning of April.. apparently her actual employer was broken into a few weeks ago and the computers, books, files and everything was stolen.. I told my mom though that since they had a CPA I would have thought that they would have the records.. I know I used to work for a drs office who had a cpa do his hours, etc every 2 weeks when we got paid.. They figured everything out and then told him how much each paycheck for each person should be .. I would think that the cpa would keep records somewhere for everyone they do taxes for.. but she states they are claiming they dont have it.. I told my mom that its up to them to supply it to her... she got her w2 for her taxes in April thru December.. My mom is going to call her cpa tomorrow.. I called her back and gave her the info about calling the irs and filing a complaint.. apparently my brother worked there last year also and he cant locate any of his paystubs at all (I dont know why he doesnt keep up with that).. so he has nothing to go by.. Hopefully this will help them both..
