Vacation is planned and i just a court appearance date while we will be away...

We are planning a trip to the world in Sept(22-27).Thats the week my husband has off.This is my problem--Sorry its so long..

I work at the local Chuck E. Cheeses here in Delaware as the bday coordinator and the week before halloween this asian woman was yelling at her son and then decides to take him the bathroom into the hadicap stall.One of dinning room girls is in there cleaning and comes running out and graps our gameroom girl to take her i nthe bathroom with her.I see this and i know something is going on either a fight or body fluids on the wall.So i go in there to see whats up and they whisper whats going on,the mom is slaming her kid against the wall in the stall and yelling at him.I told my girl to get our manager and i tell the gameroom girl to get a token from her pocket and unlock the door.This whole time u can see the kids feet leave the floor and hear him crying and hitting the wall.SO finally my managers come in and ask the woman whats the deal and she says that she didnt want her kid sitting on the floor.his woman also had her mom with her in there looking throgh the crack.So the 3 of us tell the managers what we see and hear and my GM looks at me and i tell him do it(call the police) so he calls 911 and the woman is trying to grab the phone away from his face more then once.I am telling her "maam please dont touch the manager" and my boss is like if ur not hurting ur kid then why would 3 employees being telling him the same story.SO this group really was trying to leave before the cops got there and they finally show up and get our story and take the woman and her kid away in 2 different cars.
Jan we all get a paper in the mail saying we have to show up for court for what happened.We show up and its delayed and the court says they didnt know we were there even though they have u sign in and show ur paper.So it gets pushed back and one of the 3 charges against her is for touching my boss.
So today they send out the new court date and its for Sept 24.We will be in the world that week.I wont be home here in delaware as we will be in florida.What i am supposed to do?I guess i will call the number and see what can be done.I asked my dinning room girl to ask her dad who is a lawyer what i can do since we have a vacation planned..
 
You have plenty of time to see what you can get done.
See if you are allowed to give a Sworn Deposition instead of having to be there.
It’s either that of try to have the date postponed again.

DO NOT under any circumstances call the woman's attorney, even if it is a public defender. If you have any questions they need to be directed to the prosecutor.

If it is a subpoena then you MUST call the prosecutor because that is a court issued document and if you don't show up you will be in contempt. This far out, I doubt it is a subpoena but I could be wrong.

The court will not know what to tell you, and in most instances can't give you any advice anyway. Call the prosecutor since you are, most likely, a witness for the prosecution.

Its a summons for a non-jury trial.Its gives me a number for the clerks offfice.Then there is a number for the attorney generals office if u are a state witness/victim.Its the state against this woman.I guess i will have to call both and find out.
 

The clerk's office probably won't have any clue what you're talking about. They keep track of who knows how many case files.

Seems odd that the Attorney General is prosecuting the case. I would have thought on a small criminal matter it would be one of the district attorney's (or asst. district attorney) prosecuting the case. But, each state is a bit different.

Between now and the date set for trial a lot can happen, most significantly would be a plea agreement and then no trial. Also, before you would be called as a witness more than likely you will either be deposed (under oath) or subject to a pre-trial interview (not under oath).

Definitely give the prosecuting attorney a call and talk to him/her about your plans. They know that people do have plans and can work around them given it is 6-months out. Don't expect them to reschedule the trial for you, but give him/her plenty of time to make the necessary arrangements to preserve any of your testimony.
 
You must call the prosecuting attorney's office--whether that the district attorney, state's attorney, or attorney general (specific titles and lingo vary depending on the state or county of the incident). The court clerk cannot help you.

Since there are several witnesses, it's possible the trial could go in without your presence. It's also possible the trial date could get changed. If the prosecuting attorney believes that you are necessary for the case, he or she will probably ask the judge to postpone the trial again due to your previously planned vacation. But again, you need to contact the prosecuting attorney's office.
