UNbelievable!!!!

Thanks for your advice & good thoughts everyone. I feel like we've been through this more than our share of times. When my minivan was totaled, my hubby had just had a boat hitch installed, so the ins company did add that to our total -- & we were able to get the exact same van -- well about 20,000 more miles -- for almost exactly what they gave us. BUT the other driver was insured.

I don't know if the other driver was ticketed on the spot, or if it will come later. I'll have to ask my husband. All I know is I am one GRUMPY gal today!!!

My mom used to say "When it rains sometimes, it pours!" If it helps, we have all been there, or at least most of us, once or twice. It will get better!
 
We do have uninsured insurance -- but I'm afraid they are going to total out his car & let me tell you, it's not worth much :( I am in Wisconsin, I have no idea what the laws are about being insured -- because I've always been insured! We won't know anything until our ins. company sends an adjuster. He JUST got new tires on that car too :(

My MIL called tonight & I told her the story - she also suggested suing. She & my FIL did that years ago & they got 3x more than what the ins company was going to give them. Not what we want to do but if he's driving a brand new vehicle he must have $$$ - insurance or no insurance. I'll keep you posted!

One thing most people do not realize - YOU have the option to NOT allow them to total the car! They may only pay out the car's value in repairs (that varies by state) but you CAN force them to fix it instead of total it.
 

I was hit by an uninsured moterist and my insurance company sued. (Car was totaled) I would ask your insruance company why they aren't suing if they aren't! And you will know if they do, I had to go testify! Woman lost her licesnse and if she ever gets a job her wages will be garnished.

I know it's not much, but...

My car was VERY new so my insurance company had to pay out a lot of money which might have encouraged them to sue, but I was GLAD to help.
 
Call your insurance carrier. Odds are you have uninsured/underinsured on your policy. If you do, you shouldn't have to pay anything and they will handle it all. Years ago, I got rear ended by a 16 year old. He knocked me into the van in front of me and the van hit the truck in front of it (we were at a stoplight). His insurance only covered up to $10,000 in damages and I had to call my carrier about it. The agent told me I would have been better off if he hadn't been insured at all because you have to pay a deductible for underinusred, but nothing for uninsured. As it turned out, he had just enough to cover everyone.

I was rear ended recently, the last car hit in a four car pileup. Everyone had insurance, except the moron who was texting when he ran into the first car. We still had to pay our deductible, as well. It sucks, I'm sorry.:(
 
Just an FYI about the tires, I had a car totaled once too the same day I had it painted, new tires put on and some other work done. Anyway, while we were waiting for the adjuster we swapped the tires with some old ones and my dad was able to use the new ones I just bought. I didn't want to see 4 new tires go to the junk yard for someone else to salvage and use!

Absolutely. My truck was totaled a week after I put new wheels and tires on it. That was $2000 worth of wheels and tires. Combine that with $5000 worth of stereo equipment I immediately pulled the equipment out where it was towed to and swapped out the wheels/tires with the old ones. You would have to do this before any insurance adjuster arrives to look at it.

Here's the kicker for me. The old tires were completely bald. The wheels were plain jane steel wheels. Before putting them in the garage after getting the new wheels, I scrubbed them up and sprayed each of the entire tire with tire foam. I've said before in this forum that I received an extra $1800 with a list labeling all the extra amounts. It was an extra $100 for the "extra clean" condition of 4 ugly steel wheels and 4 bald tires.
 
He has a brand new Yucon and no insurance? Did he ay cash for it? I ask because in California when you buy a car it has to be insured if you are making payments. They give you some time to get back to them with them with the details but most of us have insurance on the car we already drive and it carries over to our new one.
