Dec 31-Jan 8th 2017/2018 is out planned vacation time

1-What are the typical refurbs at this time of year?

2- can you upgrade magic bands ?or can you only just buy fancier ones? And. The cost and options?

1- There are usually not many "typical" refurbs the week after Christmas week because it is WDW busiest time of year. With that said whatever long term (major) refurbs are going on will still be closed that week. You'll know about these way in advance of your trip.
2- I don't think you can upgrade your bands, I did see a site that sold vinyl overlays you could buy. And yes you can buy fancier ones, prices I have seen were @$15 - $25.

Keep in mind the new magic bands will be out soon.
 
Starting in early Jan, Splash is often closed because its less frequently ridden in the cooler weather, so if they can get some work done on it, this is when they've chosen in recent history. Kali too for that matter.

Other than those, I can't think of anything that is typical. Its just what needs upgrading, I guess. Maybe you could get an idea based on what has recently been shut down, assuming it may not need a major refurbishment in the near future, but its a roll of the dice.
 
So arriving Jan 2nd to say the 9th is still very busy? Do the crowds not lessen right after Jan 1st?

The crowds lessen after schools are back in session from the holiday. So, depends on the year and how the dates fall.
 
One of the two water parks will be closed.

You can look at new bands on the Shop Disney Parks app but it will be a whole different selection by the time you travel.

With Jan 1 being on a Monday next year, I wouldn't expect the crowds to lessen until the end of the week. However, the WDW marathon is scheduled for Jan 3-7, so that will also impact crowds. It won't be Christmas week crazy busy, but it will still be 7-9 crowd level busy.
