Our REAL boss is in the National Guard, he is very high ranked, only one more spot he can go up I think but for the life of me I can't remember what his title is. Anyway lets get to the point. He got called to active duty last year for an 18 month stint that will be over in November of this year. Most of his unit was activated and is in Afganhistan (?sp), he was asked to stay stationed here to man the armory and the few left there. So he is on military leave from here, he is the Warehouse Manager(WM). When all this happened he went to the Complex Manager and spoke to him about it, they said everything would be fine, even set him up so that he could access his email etc from there to make sure things were still running smoothly here.

Since then the Dock Supervisor (DS) has gone and told the Complex Manager (CM) that he don't think he is coming back, he thinks he is going to stay at the armory, etc., etc., etc., which there is no truth too, WM hasn't been offered any permenant position there when the unit comes back. So yesterday the DS with the CM's approval, cleaned out the WM's office, took all his stuff off the wall, etc., throwed a bunch of stuff away and moved into his office.

In my opinion this is so wrong......I don't even like working here anymore. :worried:  :(

Do I understand that the WM (your boss) was activated by orders from the President? If this is so and the company has a set of his orders, then what they have done could be a big problem. Now, if they are cleaning out his office to re-aline the offices in general then no problem. BUT.... if they have changed his job, fired him, or given him a lower paid / position, then the compnay is in the wrong. The Guard and Reserve are protected from loosing positions and status in a company if they are activated by the President. Your WM will need to contact the ESGR http://www.esgr.org/

I hope things work out for everyone.
If I can help you in anyway please let me know via PM.

We really don't know yet what they plan to do. He was indeed activated and has activation orders which he took to the CM when he was notified. He did come by weekly to check and make sure things were okay even though he isn't being paid by the company right now (the armory is just about 15 minutes from here) as his military pay exceeds what ever they base that on. A few months ago they told him not to come back and told us not to be calling him, emailing him, etc. The CM didn't even have the guts to call him and talk to him about anything, he just emailed him and told him he needed to come clean his stuff out of his office. But he didn't so CM to DS to do it (or so DS says). I asked what they intended to do with WM when he came back and DS said that they (he and WM) will be equal. Lets see, WM is a college graduate with over 15 years managing this warehouse and he is going to be equal with DS who is a high school drop out with less than 5 years even working at the warehouse and not even a year in as a supervisor. PLEASE...................BTW.....I only believe about 2% of everything DS says, he tells everyone a different story. IMO he is a lying, snake in the grass, coniving person.

Don't get to worked up of this. As membes of the Reserve and Guard we have rights and the federal govt will not let that go to the waste side. It could be a bit of a battle, but if the WM is in the right and did as he needed to do by law, then the company will need to explain to the govt why they did this.

On another note! If you are friends with the WM and or want to speak with him, the company CAN NOT TELL YOU NO! But, if you are playing the he said this game I would be careful, you may not have any protection from what they could do to you because they feel like it. I would however let your WM now about the ESGR.

We dont have to deal with this thank goodness because DH is active duty but from what I do remember your WM is supposed to be able to come back to the job at equal status and pay to what he left. I dont know for sure if that will guarantee his old job back(job he was doing when he left) but he should come back to a job!

Ok, I can't stop thinking about this. I was activated a few years ago and we had briefings about EVERYTHING you can think of and ESGR was one of them. I stayed back at my unit due to pregnancy while everyone esle went overseas. I took on many jobs and one of the was First Sgt, so I have delt with the ESGR thing a little.

Again I will say that if the WM followed the rules and gave all the info he needed, then the company CAN NOT take away his job. The ESGAR site is the best place for anyone to visit about this issue.

Please let us know what happens.

KC10Family is right, your WM is protected by the Sailor Soldier Act, he should contact ESGR or JAG ..... ASAP. Sounds like he may have to put up a fight but as long as he followed SOP (standard operating proceedure) he should be safe.
