SILs SSR purchase not closing!!!!

My SIL and brother passed Rofr on 5/18 (it was sent 4/18). They are still waiting on the sellers to sign/notarized.

I mean, yeah, the seller are international so it takes longer BUT ARE THEY BACKING OUT?!!!! What is going on?! This is ridiculous!!!

The broker is the one that is no longer preferred. The point of contact, Shawn ray, is not my favorite person. Sharon, who is great, left to go to another broker. I used to just reach out to Sharon who would get things done. Shawn ray says there's no reason to think the sellers are backing out BUT WILL NOT CALL THEM.

Getting frustrated.

I booked a trip in January for my family, as well as my brothers family ON MY POINTS. Waiting on this purchase to go through so I can release my points and bank (with my brother using his points instead). My banking date is sept 30th.

I think the sellers are backing out. It was a 170pt contract for $65pp, June use year. No points until 2016. Seller and buyer sort of split ($100 off for buyer) closing, no 2015 maintenance fees (bc no 2015 points). Buyer pays admin fee of $195.

Any advice?! Sellers have had TWO MONTHS TO SIGN!!!!!!

Keep and eye out for other listings in case this deal falls through.
Next time use a different broker.
Ask the broker next time if the seller is in the US.

I would demand for an update. we passed ROFR on June 21 and already are members and have our number and DVc package and we, the buyers, were international. There`s not reason for internation to that long! That`s a very good price btw!
 
Did they have a closing date written into the contract?
If, yes and that date is past they can cancel the contract and possible get a non-performance settlement from the owners. Check with a lawyer for details before doing anything, I am not one.

Ditto what they said. On our contract is says closed by "." Unless extended by the title company for administrative reasons. I would look in to that.
 
I have purchased two contracts from international sellers, and never had a bad experience. Both contracts closed in the normal amount of time. I have however, had to cancel a contract from sellers in NY because they would not send in the closing documents. I used the "close by" clause in the contract and got all my money back. It was a pain, but if the sellers aren't returning the documents after two months, I would cut my losses and bail.

The delay without an update is unreasonable, not to be willing to reach out to the sellers is also unreasonable. Personally I'd push to get information and start looking for a replacement. There should be a closing date in the contract, if not, the broker sell down on that end as well. If there is no closing date or it's not passed, then they might be on the hook for the deposit if they cancel.
 
Thx... My SIL is desperate for this one contract to go through. Apparently my brother said he's not going to go through with another one if this falls through.

Why would he? I'm charging him almost half what a broker would pay me for my particular home resorts... At least for our upcoming trip in January.

;( oh well. Guess it's good I have more points than I need for my family.
 
I'd let the broker know, and perhaps contact the title company too who actually handles the closing, that I was thinking of canceling, assuming it was past the listed closing date and there continued to be no communication.
