Should This Judge continue to Serve?

To me, the fact that she was irresponsible enough to drink and drive, an illegal activity, is enough to call for her removal from the bench. A judge should know better than this. By choosing to knowingly break the law, she made her bed.

She has been given Accelerated Rehablitation for this. It is a law that allows anyone who qualifies and is accepted into the program a second chance. When she completes her obligation, she will have no arrest record, no conviction and a clean slate to start over. If we allow felons to access this program, why not someone who commits a misdemeanor? Should she be held to a hire standard? If she was previously accepted into this program, what right did the police have to release the video? It seems that they are violating her privacy that will be ultimately guaranteed when the record is sealed.

What is the Accelerated Rehabilitation program? What constitutes the program? Is it only for people who have been accused of a DUI/DWI? How long does the program last? Does the individual lose their license? If not, is the license restricted?

In the state of CT you automatically lose your license for 90 days on the first dui offense.

The AR program is available to those who have been arrested/charged with a drug or alcohol offense, not just DUI. You are only allowed to do the program once.

You must pay a $125 fee to apply for the program. They then contact you and you go in to speak to someone. They ask tons of questions and then recomend to the court if you should take 10 classes or 15 classes. Also, generally, if you blow 0.16 or over you take 15, below that and it's usually 10.

Then you go back to court. You pay $350 for 10 classes or $550 for 15 classes. You then attended weekly classes that are 1 1/2 hours in duration for the required amount of classes. If you show up drunk or high or you fail to go to the classes it is reported to the court.

Its a program that is offered for first time offenders for a variety of offenses; misdemeanors, DUI/DWI, some felonies, etc. It can only be used once in a life time. Once the terms of the conditions are satisfied; alcohol treatment, probation, community service, etc. The record is sealed, including any record of arrest at the arresting precinct, and the only access anyone has to that record is the court, should someone reapply wrongly to the program. Its a one shot deal. I would assume her license has been suspended since that is the normal procedure during a DUI arrest in Ct. anyway.

I just realized that I didn't describe the AR program. I was explaining the Alcohol and Drug rehabilitation program. I assume that she is doing this program since it was a DUI charge.
