I am not an engineer, but if Disney says it's unsafe for my kid who is 1" short of the restriction, who am I to argue.

My husband's an engineer and he says if Disney says its unsafe for under 40 inches, its unsafe for under 40 inches. The heights aren't arbitrary and an inch can make a difference in how the restraints work.
