I think the answer to this question is yes, but thought I should clarify anyways. If I buy into DVC at 160 points and later decide that 120 is best, can I sell just 40 points of my contract and keep 120? Thanks.
 
No, contracts cannot be split up. It would have to be sold as a whole.
 
Unfortunately, the answer to your question is "no".

If you buy a single contract for 160 points, you cannot resell only 40 points later. You would have to resell the 160 point contract and buy a 120 point contract (which is a lot of closing costs etc).

You will see a lot of advice on these boards along the lines of buying smaller contracts. The ability to sell off a portion of your points is one of the biggest reasons for that advice. If you start with a 120 point contract, add 40 points later, and then decide to scale back (or sell points at one resort to buy at another or give points to a grown child etc.), you can sell the 40 point contract.

Unfortunately, if you buy directly from Disney, you have to start with the minimum point count (which I believe is the 160 you referrred to). If you start with a resale contract you can start with a smaller contract and then add additional contracts either through Disney as add ons (in which case they can be as small as 25 points each without financing or 50 points each with financing) or you can add points with resale contracts (to make it easier on yourself, you would want to add those points in the same Use Year if possible).

:thumbsup2 Yep, that's what happened to us. We thought we were buying extra when we started with a 230 point contract, but a year latter, we added on another 150 when we discovered we used it MUCH more than we first thought we would.
 
The answer is no if you try to sell your ownership interest to a 3rd party; however, Exhibit 10, section VI, to the Public Offering Statement sets forth: "you are only permitted to sell your entire Ownership Interest in a single transaction; unless DVD is willing to accept a transfer of less than your entire ownership Interest from you." Therefore, DVD can buy back a portion of your points.
 
There is an earlier thread discussing the price that Disney is willing to pay to buy back points. It was such a low price that I think its cheaper to sell your contract (on the market) and buy back new points, but you'd have to check on that price (since that thread may be dated). It was certainly less than the price at which Disney exercises rights of first refusal.
 
You could also buy a resale less than 160 pts and if small enough, do an add on to that as well. I know people who bought 25 points then did a 25 pt add on with no other ownership interest in DVC.
 
Why not buy the min 160 total in x amount per contract. You might think of 40,60, 60 or 60, 50, 50....or whatever. They used to let you buy multiple contracts as long as they add up to the minimum. Then you would have a choice of which one(s) to sell depending on what fits your vacation habits.

If you buy direct from DVC you have to acquire at least one contract of 160 or more.

Resale sounds like the best alternative.
