Hello:

We have been coming to Florida for the last 8 yrs. We have been renting from one management company only.

We have been leaving our security deposit with them from yr. to yr. for the last 3 or 4 yrs.

With no notice to us the management company is being run by different managers but still the same boss in the background and it still also has kept the same name.

They say that now that since they have changed "people at the front desk"
that our security deposit is gone and in fact there is a Florida law that states that they do not have to honor past contracts.

Has anyone heard of this law?:confused3:confused3
 
I would think someone owes you your money back if they aren't wanting to honor the previous contract. I'm guessing you mean they do not want to rent to you.
 
No it's the other way around, there were a couple of things that we were not too happy about and thought it was time for a change.
 
I don't understand how this company has changed -same boss , same name just different front desk people how can that create a new policy .Unless you left the last home you rented in a bad enough state to warrant them keeping your deposit I can't see how they can keep it .The only thing I can think of is that they are treating your security deposit as a rental deposit and their terms may say it is non refundable ?
 

We don't understand it either.

We sent them a rental deposit and they did take it off the total rent. That part is right.

The people that we talk to at the desk and on the phone say that they have taken over the business and that the security deposit is gone because of that, even though the same boss, the one we have been renting from for years, is still there.

In our 8 yrs of renting we have always left the home in good shape eg. dishes all done and put away and wash in (just one beds wash) with the exception of this year. The other couple that we vacation with and ourselves left the same day and we left one beds landry to do and the dishwasher needed to be unloaded of clean dishes.

Well I would not call that enough to warrant keeping a security deposit -in fact it sounds as if you are perfect guests and do the cleaners job for them.
I would consider complaining to the BBB and see if they can help.

How much was the deposit? It sounds to me like they are stealing your money. It's tricky if this money has been there for years. So you have any paperwork on it, either originally or from each time you rent? Does anything show they were holding this money for when you rented each year.

Update

We have not heard anything back from this management company. As I said before, it is not the amount of money, it is the principle. We are very disappointed in them.

This is our story/vacation 2012.

Our vacation started out a little rough, when we arrived on the day we were supposed to get in the villa, one of the wheel bearings when out in our truck. So we got to the villa a little later than we usually do. To add to all the rest of the drama over the next few days our truck had 2 more breaks. Have to chalk it up to normal wear and tear as the truck is only 4 years old.

So anyways we got to the villa, put the key in the door and to our surprise when the door opened there was someone else’s belongings there. We phoned the management company and they couldn’t believe it either. In fact by what they said on the phone it kind of sounded like they didn’t believe us.

We waited for 2 hours for them to show up. They came and realized that we were not lying. Now when I said before that I know that there is still the same boss inthe background that was the first thing they did was to call him.

They scrambled around for awhile and then offered to show us 2 villas. They said the first one was only open for a couple of days but the 2nd villa, the people that were suppose to rent it had called and cancelled and so they knew that it would be open for 2 weeks. We looked at both and decided that if the second one was open for that long we might as well go there as we didn't know how long it would take to iron out the trouble at the villa we were suppose to be in. The management co. people looked around at this residence to see if everything was in order and also turned the pool heat on.

The next morning the management co. phoned and said the mix up was the fault of one of there travel agents they use, that they gave the wrong house papers to the customer and instead of that villa it should have been a villa just down the street. Sounded to us like an honest mistake on the part of the travel agent. Also they said that we could go back to the villa, that they had a cleaning crew in as we were speaking and we could move in the next day. When we questioned them on the fact that they had said we could stay where we are they said that it was impossible that it was rented out. It wasn’t rented the night before but was by noon the next day.

The next problem we encountered was the pool heat or lack of. When we arrived at the villa we were suppose to rent and found the pool not to have heat so we phoned them again and they said that our contract stated that the villa was rented without pool heat. We have ALWAYS rented the villas with pool heat. So we had to go back to our e-mails (thank goodness for lap tops) and prove that in fact we had paid for pool heat.

They hummed and hawed and said that they guessed we were right but they couldn’t turn it on then because it was to cold. So for the 22 days that we had paid for we had water warm enough to swim in for 11. It was so unfortunate because our daughter had accompanied us this trip and we were all looking forward to the pool. She never got to swim once.

The rest of our holiday was lovely but it sure was stressful the first few days.



We will be posting a complaint with the BBB and for sure never renting with that company again.



Can I name the management company, or is that not allowed?
 
Well it sounds as if this "new " personel do not have a clue! 2 hours to turn up for a complaint that is really important that in my book is not acceptable-that is 2 hours of your vacation time wasted through incompetence.Then to book out a home that was available AFTER they had put your family in again bad business practice really .As for no pool heat -was it really cold for 11 days -below 55 degrees or so ? if not why wasn't the heat turned on -did you meet anyone staying nearby who had pool heat?
Definitely report them to BB and also I would ask for a partial refund for the upheaval and lack of pool heat.The treatment you have had is not acceptable in my book and I for one would like to know who this company is so they may be avoided .
Please let us know how the complaint goes with the bbb.
 
The name of the villa rental place is Classic Management.

There were nine days in particular that we were disappointed that we had no pool heat. Those were the days that our daughter was there.

I looked up a weather site and got there weather history.

The average highs for the daytime was

1 day in the 50's 52
2 days in the 60's 66 63
4 days in the 70's 78 78 74 78
2 days in the 80's 81 81

Night temp.

2 days in the 30's 30 32
2 days in the 40's 45 46
1 day in the 50.s 53
4 days in the 60,s 62 64 64 64

In 2010 it was very cold and we had pool heat the whole time.
 
Given those temps I would want to know why the pool wasn't heated if I had paid for it .Keep on at them and put down all contact you have with them for your records.
 
The time is up as far as the BBB is concerned. They were even very generous in the fact that they extended the time the file was open twice.

Does anyone have anymore ideas.

We are just too far away to get a lawyer involved.

So we will likely chalk this up to a lesson learned.
