champagne27 - Wow!! Thanks for worrying about me!!! I was REALLY sure that I had read something SOMEWHERE that you had to make your closing date at least 30 days out from the day you were writing the contract, and if you have not heard from
DVC on the date you were supposed to close, you can go ahead an close. So, it's not that DVC has a "time" to respond, but DVC's lack of response cannot keep you from closing if you have given them at least 30 days.
However, I cannot seem to locate where I read that...so, if you cannot find it....then, it is not true!!! One of these days I will find it.
In my case (and, in Magicalfun's case) we are both buying from an individual with no broker involved. I didn't think there would be any "drawbacks" to not having a broker....but, it seems there just might be. There is no one who "knows" the rules watching out for us. I think part of the reason DVC is "dragging their feet" with us is because they can. If there is no "time crunch" to make a decision, why not hold onto the contract and see "where the market goes"....this contract may look like a "better bargain" in a few weeks.
However, that is not what my closing agent says....she says ALL of her contracts take 30 days. I TOTALLY expect that Magicalfun and I will hear late Thurs or early Fri (although, our closing agent says that when an agent is not involved, DVC does not always send out emails saying that you passed...sometimes, they do it by "snail mail"). So, even though we may not hear this week, I suspect we will be thru ROFR this week.
DVC ROFR is a STRANGE thing. I have a friend who submitted to ROFR on an AMAZING BCV contract (3 years' worth of points), and he got thru in THREE days...he submitted on 2/17, and was told that he passed ROFR on 2/20. Even his agent was shocked on that one!!
The reason I started that thread was because I was trying to "make sense" of the ROFR process. I thought if we "pooled" our knowledge, we might discover some things about the process. One thing I have discovered from the results posted on the thread is that the ROFR committee meets Monday and Thursday mornings. That is about about all I have learned (along with a better idea of what will pass and what will not). I have not noticed a correlation between how long it takes to pass ROFR, and the chances of you "passing" or having DVC take your contract. I also thought that DVC might "pool" contracts to examine them (look at all VWL on one day, all OKW on another, etc)...but, that doesn't seem to be the case.
I would LOVE to know why some people pass ROFR in three days, and others in 30....maybe my agent is right, and it has more to do with your closing agent, or maybe it has more to do with the "guest" who is buying. My friend is a LONG time DVC owner...so, maybe they just "passed" him quickly. It is a very interesting process...one of these days I will "figure it out"!!!
Until then....I'll just suffer through!!!
Hang in there champagne27 - it is a miserable process, but the more you "dwell" on it....the longer it takes. Remember...a watched pot never boils. I imagine you will hear in a total time of 2.5 weeks. That seems to be the "going rate". Try to relax until then!!!
